God,

This one is a mess, hopefully someone will have some advice. I'm the second English man, and the other players in this are my future wife, Lila, and her husband Christopher.

Lila and Christopher married about a year and a half ago, and she is filing for divorce from tomorrow. The divorce will go through before his two years are up, so my understanding is that he will have to return to the UK.

The reason she is getting divorced is for me, and obviously we're concerned that her previous marriage will affect our application. Assuming that he goes back to the UK so there is no longer any immigrant in America, will this cause us a major problem?

Going into more detail, this is definitely not any immigration scam. I've visited her twice since November with her husbands knowledge, and will next be visiting in April. Obviously from now on I'll be keeping all proof of tickets/time spent together in order to progress the immigration application.

Has anyone been married to two immigrants? It's an awkward situation.

*grin*, it's an awkward situation. We won't have any problem with providing all the evidence of contact and proof of visits, anything like that. I guess the real question I have is who do they pay more attention to, my status (Never been married, never tried to immigrate before). Or her status (one previous marriage, no children from it, him going home).

I think they'll pay more attention to her, instead of you or the other man.

I wouldn't marry a woman who is cheating on her husband. How would you feel if eventually down the line you'd be the cheated husband instead? How can you even trust her?

Seems like she has an affinity for Englishmen. Be careful she doesn't dump you over another one.

What makes you think that Christopher will have to return to UK? To the best of my knowledge, on their divorce, he would be able to apply in his own right to have the conditions lifted.

Sheesh, people, let's try to answer his questions first.

To the OP: your fiancee's first husband will, in fact, be able to petition to remove conditions on his permanent residency even after his divorce, provided that he is able to show that his marriage was bona fide and not entered into for the purpose of gaining an immigration benefit. It happens all the time.

Your fiancee will want to be certain that her divorce is final and she does have the complete decree in hand before she files a fiance petition for you. Your petition won't be approved before she can submit that documentation in full. If you have been previously married, you'll have to do the same.

*cough* It might look a little suspects on your fiances part........ I'm unsure if you'll have problems or not. You've got evidence you've met etc so thats ok, they just might look further into it because of her previous marriage.

I think somewhere on the myriad of forms the USC has to say whether they have previously sponsored another alien, but can't remember where. Sorry! Not much help!

Yes, she will be asked if she has sponsored another immigrant in the past, and she will have to answer yes.

Also be aware that the I-864 she signed for her husband's adjustment will still be in effect. It says in big, fat, bold type on the document that divorce does not end the sponsor's obligation. She is responsible for ensuring that her husband does not become a public charge until he becomes a U.S. citizen, can be credited with 40 quarters of work, or departs the United States permanently.

I wouldn't marry a woman who is cheating on her husband. How would you feel if eventually down the line you'd be the cheated husband instead? How can you even trust her?

I think many people on this forum always think negatively about you. I don't think that your fiancee will be cheated on you...sometime just the first marriage didn't work out just the way she wanted. Life is very difficult and very risky when come to marriage. Many people here are now in love deeply, but they does not think about the future. If it will turn out to be good, yes they will happy and proud of themselves. What about if the marriage turn out to be a mess? I am wondering what will they be thinking? Just like I said in the above...Life is risky...I would take my chance to be with someone that you love..you never know, you probably have a warm family and happiness with this woman. These people here in this forum DO NOT know about history of your fiancee...You are the only one who do know her best. Best of Luck to you...

I agree!! No one outside of ur relationship with ur girl should make judgements. I married a wonderful man, but we had so many differences we couldnt make it work. My fiance i have now, I met before my marriage broke up. He had absolutely nothing to do with my break up . To the outside world it may look that way. NO one could see behind the walls of our home. The pain that I was going thru or The fact that I worked so hard to keep my marriage together.. going to counselors, etc. Finally I realized it was hopeless and I moved on. My husband will be first to say, he was to blame, he defends my relationship with my fiance to anyone who critizes. I dont ask for anyone to approve of my decisions.. but i do ask that others dont judge my situation. NO one has the right to do that but the parties involved. Appearences are not always what they seem.

There was nothing mentioned at our interview about the fact that i knew my fiance two years before my marriage broke up. So I dont think it will be a problem as long as both of you are free to marry at time of the petition.
