Currently on OPT Extension and going to marry US citizen in my home country

Hi,

I completed my PhD last year and am currently in US on F1 visa under OPT extension. In January 2013, I plan to marry a US citizen in my home country (India) and I plan to go back to India in November 2012.

I would like to come back to US soon after my marriage and trying to find which option allows me to do this. I believe, I have two options.

1. I apply for K3 visa and wait for 6-7 months before it is approved.

2. I continue to work remotely for my current company when I go back to India and come back under OPT Extension, and only after that we apply for I-130 petition.

Are there any other options? Any problems that can arise in second option?

Any suggestions will be helpful.

K3 was create cause a few years ago, trying to get a CR1 visa (foreign spouse of an US citizen) took years. Now the process is less than a year so basically the k3 doesn't exist anymore

You should keep working remotely but wait for your CR1 to be approve and come back to US. I don't if having so many procedures going on (OPT extension and a CR1) at the same time, could be good for your case.
