I was born in the USA, american citizen from birth. I was married in Peru 3 years ago. We had our son in Peru last November.

I've lived in the US all my life.

Excellent then file for the CRBA (consular report of birth abroad) for your son. He is a USC by birth and eligible to get his US passport.

Only one more thing......do my wife and I need to have a DNA test done and take the results to the embassy when we have the appointment? If so, does anyone with knowledge of Lima know how long it takes to get the results after submitting the DNA evidence? Is there a specific clinic we have to go to? Im figuring to go and meet her in Lima a few days before the Appointment if this is needed, get it done and have it if so needed. I cant see any information about this specific topic. Im thinking they would want proof. I've heard this, but cant pin it down as to whether its true or not. Perhaps its only needed if a person is going the petition route for wife and son, rather than the CRBA if there is some reason they choose to do so.

If DNA evidence not needed for CRBA then this would definitely be a rather easy process if all goes as planned.

Have you read the links with the requirements for CRBA? DNA evidence is not typically needed for this. I really encourage you to read the information from the Embassy website, as the information is very specific.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

As the above poster stated this is often country specific. Typically though if the child was conceived in wedlock they don't ask for DNA, outside wedlock they tend to ask for it. They WILL tend to ask, in either case, for proof that you were in the country at the time of conception, an affidavit and stuff like that listed here: http://lima.usembassy.gov/birth_abroad.html , you are this one "Birth to a U.S. Citizen Parent married to Alien Parent and Birth to an unmarried U.S. Citizen Father" which instructions are here: http://lima.usembassy.gov/birth_abroad/one-us-citizen-parent.html. The first link states you will need to book at appointment online. Make sure you get all the documents together and then book the appointment. This link: http://lima.usembassy.gov/passports_for_minors_under_16.html is about applying for the passport and contains the link for booking an appointment online.

Read the embassy info, prepare what is needed and start the process. If you get asked for DNA, aside from cost it shouldn't be something to worry about because you know the kid is yours. It's a relatively quick process (a month is typical) where the CR-1 process for your wife will take at LEAST 6 months.

You have to make an appointment online (I did my son's CRBA last year) and then, you will need to go to the Embassy that date with your evidence (pre, post natal info, marriage certificate, pics of you with your baby in different stages -if you have-) DNA is not needed to the first interview (we didn't need it). And if they believe you need it, they will send you to some specific doctors, if you show a DNA test that it's not approved by them, you will just throw your money, 'cause they wont consider it.

At the same time you can apply for a US passport, and they will give it to you most likely in 10 calendar days. (we applied 10/17 and pick it up 10/28)
