Timeline

It is now almost November 2006. My husband went to his interview on September 18, 2006. The immigration officer had told my husband that he did not have enough evidence or documentation of our dating relationship. Mind you my husband presented documentation since our marriage for 9 months and the officer did not have a problem with it. We both have been calling and emailing like crazy. My husband is still in Nigeria awaiting the "administrative processing". For those of you who don't know what that is it is a way of delaying his visa by trying to dig up dirt so that the embassy can justify denying. Has anyone had any dealings with the embassy in Lagos? I wonder if I go there in person and protest would they grant him his visa. Somebody Please :help:

Did you receive a rejection document from the Consulate Lagos? Are you required to provide more documentation?

I worked in Lagos when it was an Embassy and after it moved to Abuja, albeit not in the Consular Section.

Nigeria tops the US State Department list of Visa fraud. What does this mean to you? You need to provide "slam dunk" evidence of your relationship, simple as that. Apparently, that has not yet happened.

Did you get an outright denial, or a temporary denial pending further evidence?

If temporary, you can fix it. Iy might require a personal visit by you. In this location, a personal visit with additional evidence is most beneficial for success. Having seen the queue in Lagos and Abuja, usually several hundred deep, you must have convincing evidence for these Consular Officers.

As you know, A protest outside the Consulate Lagos will yield nothing, although I realize that this thought was out of frustration.

Please provide more detail.

It was a temporary denial pending investigation. On Sept. 18th he went for interview and got temporary denial because he did not have evidence of our dating relationship. My husband told him that we did not have. That following Friday, he went back with what little he and I could find. The officer said it was not good enough and it had to go to administrative processing. I want to go in person but what steps should I do? It makes no sense to me why the embassy requires documentation because in Nigeria you can get "evidence" that is not even true and present it and the officer would have no idea. What more evidence could he or I provide? We were truthful in stating that we did not have the emails of our dating relationship. And if this were a fake marriage would we continue to communicate on a regular basis for 9 months? We could have made up emails and letters but we decided to be honest. After we were married we decided to change our email address because we felt that this is new. We left the dating ID's behind because we did not want someone else to interfer with our communication online.

Do you have any other evidence? Such as documentation from visits, phone cards or bills, bank statements with money transfers? Anything? Are the previous e-mail accounts terminated or just inactive?

You really need to produce some valid evidence. This is the sticking point as you described it.

Yours is a common tale. As one immigration attorney who posts to internet discussion groups writes, and William concurs, 'in the continuum of visa posts based on fraud, it's low-fraud, medium-fraud, high-fraud, Nigeria'.

Given the weight of the anecdotal evidence, my feeling is that anyone who applies for a K or immigrant visa in Nigeria without first consulting an immigration attorney who has experience with that post is doing themselves a grave dis-service.

The issue is not do you love your husband, the issue is did your husband marry you because marriage to a USC is a relatively easy way for a person to emmigrate to the USA.

Getting married on 1st and only meeting could seem suspicious.

What do bills to you with both names on them prove about his reason for marrying you?

What does you sending him money say about his reason for marrying you? If it says anything it's not necessarily positive.

The issue is not do you love your husband, the issue is did your husband marry you because marriage to a USC is a relatively easy way for a person to emmigrate to the USA.

Consult with an imigration attorney whos has experience dealing with the consular section in Lagos, have them review what you've got and advise you on what else you should try to obtain given your circumstances.

At this point, is demonstrating "love" a priority?

Understand that we love our spouses too, and we are not questioning your love for each other. The CO isn't too interested in love either. S/he is interested in the topic Yodrak raises. Ugly or not, it has to be dealt with, so make sure you are fighting the right battle.

I'm sure they do and I fear that you may be. You and your husband really needed to get professional advise on how to present the visa application before it was submitted and the doubts created, but that's in the past now.

Try calling the office of Stuart Folisnky in Los Angeles and see if they can recommend a good attorney for dealing with Lagos.

I wish there was something more that I could add that would be helpful to you, but at this point there isn't.
