I filed for my mother and she came into US 2011 and she is not working and now she has filed for my younger brother in which i believe in fours years he will be approved .my question is that can i be joint sponsor for affividalt of support or not because my mother is 70 years old and she can not work despite the fact that she have her own greencard.Please advice me if my younger is approved who is going to do the affidavit of support?

You can be a joint sponsor but she is still counted on your household size because you are her sponsor.

You can file as a Joint Sponsor on the petition by your mother for your brother.

If your mother is 70 years old, then how old is your brother?

When an LPR petitions for an unmarried child, it takes 2-3 years to petition for an unmarried child under 21 and 8 years for an unmarried child over 21. You can only file an Affidavit of Support near the end of those wait, so I don't understand where you are getting 4 years from.

With your mother's age, I am bringing this up to help you and not wishing your family any harm (Asian superstition). If she dies at any time before your brother immigrates to the US, the petition will also die. You might want to file for your brother also and have your petition be a backup.

you can do the household member form i864a when the times comes or the appropriate form at that time. i'm in the same situation as you/mom/brother.

Humanitarian reinstatement is discretionary. It is not always granted.

Wouldn't it be better to just file a backup I-130 for a few hundred dollars to save the stress and uncertainty of applying for humanitarian reinstatement?

How about giving people good advice like filing a backup petition rather than rely on the uncertainty of humanitarian reinstatement?

Would really suck if mom dies in year 7 and humanitarian reinstatement was denied?

I'm not going to go into every little detail about every option. This would turn a post into a novel. I give what I think is the best path I know of. The better path when the petitioner is 70 years old is a backup petition by the brother rather than rely on humanitarian reinstatement down the road.
