Green Card Data Incorrect

I never listed this in a forum because I put it on my Home Page. My wife's starting date was prior to her entry, several phone calls and hours later along with two Info-Pass appointments we file an I 90. Two months later we have completed a new biometrics and received a I551 stamp in her passport. Now we receive a notice advising us to file for ROC due to their original mistake. ERR

The question is does human intervention and common since win or the computer generated letter, "I751Petition ...failure to do so may result in the automatic termination of your status". In 10 days we can file for ROC according to USCIS. ""you entered the US as a conditional permanent resident on xx/xx/xxx".

Another round of phone calls and info-pass chats are soon to be pending. :bonk:

This is better than Las Vegas, at least their you know they will take your money and keep it. USCIS desperately needs a effective system for honest resolution's of their own making.

AN ISO has god access to the computer,

why not suss it all out with an ISO, this week?

ISO useless today. Wants me to send I751 non responsive letter indicating I90 issues and he stated 6 months for resolution by then possibly out of status if USCIS does not change the date. Going for new Info-pass appointment first. It is clearly apparent the left hand does not know what the right hand is doing. My wife says we should have gone with their date. She used to think US Govt was squared away no longer has that view.

See my entry today, useless. If they take 6 months and I don't submit we are out of status. Going for Info-pass apt, then maybe ombudsman or congressman.

to be effective with an ISO, ya gotta pose the right questions, controlling the conversation as much as possible,

and somehow enable the ISO to do their job.

After being on hold for 30 minutes..... He was less than interested and took awhile to him to understand that they were a year off 2011 instead 2012. He said it would take 6 months for a new green card. I related that the letter received indicated we needed to apply for ROC in a few days. I tried to explain that if we send or money it is wasted because of the incorrect date, no refund. His only response over and over was write a letter to Laguna Niguel explaining why we were not filing and enclose my I90 documents. He did not seen to get it that in 3 months she will be out of status, subject to removal for not filing if they hold to their time line. I made an info pass appointment for next week. I will forward the letter received regarding the I751 to the MSC special handling center.

Further will contact the Ombudsman office and Congressman for how ineffective the system is to fix a simple error due to their inactivity. in some cases one should be able to get a management level person to make a decision. Wife says in China after they said everything is correct she would have filed as instructed.

Get your congressman involved, hook up with the USCIS ombudsman, involve the news media....when you talk with USCIS (tier whatever) make 'em a deal they can't refuse.... cut out the nonsense, and give her a 10-year GC. She will likely be eligible for it by the time all of their mess is sorted out. :wow:

is that fact that she has a 10 year card when she should have had a 2 year card.

you know it's a mistake.

USCIS knows it's a mistake

so - use a calendar, and figure out the 2 year span, then subtract 90 days,

then figure out the span, and file.

Just because it was printed wrong does NOT mean it's stored that way in the big USCIS computer.

Live with it, todayish.

From what I understand, she received a 2 year green card, not 10, but with a starting date a year early. Now they are at 100 days (on Sept. 23rd) before the expiration date on it and so ROC "should" be filed soon. When in fact it should be done in a year if the green card they received would have been correct.

I would honestly not know what to do. File for ROC and following the computer mistake, or try to get the original card changed with the right starting and expiration dates as bigdog is trying to do.

That is the plan, filed I90, DHS 7001 form, have another Info-pass appointment next week and if nothing else will file the I751 for ROC if no one responds. Just did not want them to take my $$ and refuse me at ROC, we will see - news at 11. Never the less will not get on the track for automatic termination of benefits. Thanks all. G

I know its wrong they cant get it, straight, we filed our I90 8/8/12. It is in their computer they sent YJ a letter on 9/18/12 indicating she arrived on 1/9/2011 as a CPR. Can't be she arrived 2/4/11 on a K-1, married 3/11. AOS completed 1/9/2012 in Phoenix. Our date should be 1/9/14 less 90. I have another info-pass meeting next week. The local IO figured it out on the 3rd visit but the computer not changing? I would use a Sharpie on the card but it would not work. So her GC and AZ DL expire on the same date1/09/13. Don't worry not going to jeopardize my TS clearance for a stupid GC.

If your infopass doesn't garner you the results you require, definitely get in touch with your Senator or Congressman. Good luck in getting this resolved.
