Fiancé in another country (other than citizenship)

Greetings everyone! I am back to find answers after petitioning for my ex-husband some years ago. If a fiancé is currently in a country, perhaps overstaying a visitor's visa/trying to gain residency documents, other than the country of citizenship, would he have to return to his country of citizenship/origin during the K-1 process? I guess I know the answer, but I was hoping to get some confirmation.

Yes if he doesn't have that country's residence's permit before the petition's approval then he should go to his home country. He has to be a legal resident in the country he is interviewing in when it's not his home country.

He has to have legal resident status in the place where the interview is held on the interview date. Also if he has been anywhere more than 6 months ( legal or not ) he needs a police clearance from there.

This will not be over quickly. You will not enjoy this.
