London DCF

I'm sure I have missed this somewhere but my head is already spinning somewhat.

1) Does Hubby (USC) just have to be resident in the UK at the time of our I-130 application?

He has a job offer to start in the USA on Jan 2nd and is looking to return to the USA around late december to get us a place to live and job started for the I-864 while I wait for my visa, finalise shipping all our stuff back and finish up work for my Dad. I'm hoping to have our I-130 filed somewhere in the next week or so.

2) My son is US citizen or should be by the end of tomorrow, heading to the Embassy to do his Report of Birth, passport, ssn bits. Brain fart I know but he doesn't require anything for us to move back other than his US passport right?

We are both here in the UK right now and we are eligible for DCF, I know that much.

Long story short, I was K1 back in 2002. We came back to UK Dec of last year and he has been here almost a year on a spousal visa. Very homesick and wants to return home so we are packing up and going back. Due to the abandonment of my residency I have to re-apply for new visa. Yay.

You can do DCF as long as the petition is in before your husband leaves which it sounds like it will be.

Good luck for your sons CRBA tomorrow! We did our daughters in August and it was pretty pain free. I wrote a review on what happened which you can see from my profile if youre curious.

Thanks holly, I read it, ready for lots of stroller carrying think we're all set, found out about Goulds thanks to all the reviews in there, going to stop in early and get some photos done, the ones I have are a bit old now and while on proper photo paper it was dad who printed them. Will feel a lot happier getting some done in the am there. Also need some for us anyway for our application.

Good plan! I had my daughters photos taken a couple of weeks before and when i got home i realised half her face was in a shadow so i had to get them taken again! Thankfully they didnt charge me again.

All done. Kiddo is officially a us citizen now. Was fairly pain free except for the pouring rain and boredom sitting around with no gadgets waiting for stuff to happen. Now to get his British passport done, same problem there that I have with the police report for the I-130, finding someone of reputable profession to sign our photos. We've been in the USA for 10 years, I don't know anyone anymore.. Grr.

I had the exact same problem, in the end i got my dentist to do my daughters passport one and my dads girlfriend to do the police certificate one because she's a legal secretary and that was just by chance! They were reading it and realised she could do it in the middle of my panic of who to ask.

Its the two year thing that makes it awkward really. I hope you find somebody to do it!

My wifes first UK passport recently took almost 12 weeks from start to finish- and that was a fairly straightforward application (born in US but english father, just never bothered getting a UK passport before) - she received it just over a week ago.

She also got her dentist to sign her UK application and endorse the photo which he was happy to do.

Yikes, thanks for the heads up, I'll get that done ASAP then, lol, who will win this race, ir1/cr1 visa app vs. British passport sadly I suspect the visa will not be that zippy.

I've never even set us up with a dentist yet, seen my dr once when i was pregnant, (most of my pregnancy was in the us, flew back at 32 weeks!) the boy has only seen his dr once at his initial 8 week checkup and a couple of different nurses for his jabs. we are not frequent visitors to anyone like that unfortunately. Thankfully dad had a bright idea this morning with some old family friends who knew me growing up and run their own business and have met kiddo. Gotta email them and ask nicely

I hope they can do it for you My dentist had never even met my daughter when she signed it! All it matters is whether they've known the parent for two years, so if it ends up that whoever does it hasn't met your little one, it doesn't matter.

Wow thats a really long wait on the passports! I renewed mine and got my daughters first one in December and it was back within 10 days.

My question is, do I qualify for DCF or do I have to send my application to the US? I have heard differing stories and I'm not sure if you have to have ILR in order to apply with the consulate. Also, I was advised that it would be at least a 10 month wait if applying with the consulate, can anyone who's gone through the process recently confirm that?

Requirements for filing i-130 in London are here:

In order to meet the residency criteria to file with this office; the United States citizen must satisfy two requirements:

-The United States citizen must show evidence (valid UK Entry Clearance) that he/she has permission from the UK Home Office to legally reside in the United Kingdom; and

-The United States citizen must also show that he/she has resided in the United Kingdom for at least six months from the date of arrival following approval of the UK Entry Clearance.

You are here legally, and have been here for at least 6 months, so yes, you should be able to file in the UK.

Also, I was advised that it would be at least a 10 month wait if applying with the consulate, can anyone who's gone through the process recently confirm that?

Ours took 4.5months start to finish (interview and visa in first week of feb)- and that included a delay for them losing my paperwork.

They are processing in good time at the moment. I would be surprised if it took 10 months for a CR-1/IR-1 via London, especially if all your paperwork is in order and ready for the next stage in advance.
