Hi,

I am new here but I am a question burning in mind, which will be very much appreciated if it can be answered.

While on F1 student visa in U.S, I was notified during the winter break of my freshman year of college that my parents won the DV. So I came back to Myanmar (where I am from) and we, as a family, all came here and got our green cards. But when we got here, my parents are more inclined to go back to Myanmar, where their business and relatives reside. So I am wondering what will happen to me and my brother here, who want to study in U.S for college education and beyond, if my parents decided not to stay here. I am turning 21 in a year; my brother is now 16. I also have a uncle here so can I change our dependence to our uncle from my parents? If I become 21, can my brother be my dependent? (I will be still in college though).

You have your greencards now, so you maintaining them is independant from your parents. Your 16 year old brother would need a legal guardian to make decisions for him, but that is not an immigration legal matter.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You / Your brother will have no issues should they decide not to stay in the US and put their own green cards at risk.

It doesn't matter if your parents give up or lose their green cards. You and your brother's green cards are not dependent upon your parents' status.

You are 21 and an adult, so you cannot be a "dependent" of your uncle.

Your 16 years old brother will need a guardian (an adult who can make legal decisions for him). As a minor (under 18), only your parents can make legal decisions for him. It doesn't matter if your parents leave you or your uncle in charge of your brother. No one else will recognize anyone else without a guardian. Your parents will need legal papers to authorize you or your uncle to act as your brother's guardian.
