I am Canadian and my American husband is filing the I-864 form. It asks to list dependents. Based on his income taxes filed for last year the household would be 3 not including myself. We have put 2 as the household (myself and him) because he doesn't have custody of his children so they do not live with us on a regular basis. However they lived with him in 2011 (just me and him now) and the 2011 forms list the childen as dependents and they have asked for a copy of the filed income tax for 2011. What should we list as the dependents.

He must also meet to 125% of the annual income to take of dependents.

Household (2 ppl) - income should be $18,000 or above

Household (3 ppl) - income should be $23,000 or above

Household (4 ppl) - income should be $28,000 or above

Minor children no matter where they reside are always included in the household count.

Also, anyone listed on the most recent year's tax return as a dependent is included in the household count.

If we add the children then we fall below the poverty guidelines with regards to his income he doesn't make $28000 and above per year. What should we do then?

What if he doesn't have custody of the children?

Is his brother sufficeint enough to be a co-sponser? He makes $100,000/yr and above?

Sure if the brother wants to, his income must cover all of his dependents and you. The brother must meet all of the other requirements aswell.
