I am confused, reading all different posting, my wife is in china and I'm a usc, Just paid the AOS fee and IV fee. I have gathered all the docs for AOS, am I supposed to file the DS 230 to NVC or do we wait for Guongzhou to request from her. Please help!!

You mentioned that you have paid both fees and have gathered all AOS docs, if you have the IV Docs as well then you may mail them off! Ensure you add the Document Cover sheet from the payment portal :thumbs:

There is no K3 anymore and will be converted. Why don't you fill in a time line and more information, for a better chance in getting help. Their are some very knowledgeable people in the China Group. See you soon.

Thanks for the advise!!! I've updated my timeline. Other questions I have. My dumb attorney says that electronic filing is not allowed. I've call NVC they've said it's possible to file electronically. I assume NVC is correct. When we filed the I-130 we included most of the docs package IV requires. Do we have to sent it in again? ie certified police records, marriage cert, birth certificate, passport photos, most of the requirement they've already have except for form DS-230

btw I'm actually filing for cr1 I believe.

whilst yer waiting - read this:

NVC EP - http://www.visajourney.com/wiki/index.php/NVC_Electronic_Processing

and prep (but not send) the OPT IN Email for NVC Electronic Processing from your foreign spouse's email.

ON MONDAY - call NVC, tell them you are gonna OPT IN for NVC Electronic Processing,

then actually OPT IN.

Once you have a GZO #, THEN and only THEN send in the documents via email.

Why to do this?

1. you've a stupid lawyer and

2. you shave 3 to 5 months of waiting time OFF of the next round of waiting for the appointment. Seriously.

so, when you filed the I-130, you sent off the I-864 and the ds-230.

Sorry, you'll need to send them again. USCIS usually tosses those.

NVC, on the other hand, needs them.

FWIW, that police clearance report with the DS-230 is, by now, expired.

Seriously, send no documents in at the moment,

instead, OPT IN on Monday, then when you get a GZO number,

start sending in stuff via email, following the steps in my wiki page.

Hit the wiki page from a PC, as there are links there for downloadable files - you really need that GUZ IV Packet 3 Supplemental to go with the DS-230.

Because of my inexperience with this process. If my "dumb ####" lawyer insists on paper filing, how long before my wife expects an interview? Will Guangzhou sent her a package that she needs to file as well? When does she need to get the medical examination.

Ah - ok - you sent some civil docs that aren't needed at USCIS.

NVC receives the casefile and absolutely keeps it shut, that 'stuff' from USCIS. It's held at NVC until the rest of the stuff shows up from you,

then all is bundled together and sent off (that's for paper casefiles) However - if you were still doing a papercasefile, is possible to get a NVC supervisor and ask that the police clearance certificate be pulled from the casefile and added to the DS-230 for IV processing.

I'll recommend something else, though.

1. well it's a toss up. you still have to submit things into NVC, so figure another 3 to 4 weeks until the 'casefile is complete' . Then a final review is done, and (unlike the rest of the countries) the casefile is sent out to GUZ IV without any interview date set. 1 to 3 months pass, and GUZ IV finally opens the casefile. They take a look at the casefile, then send out PACKET 4, with an interview date 1 month out. Figure 3 to 5 months from whenever the casefile is complete at NVC, to her getting an interview date with the date being one month later.

2. No. She'll only receive an interview letter.

3. After she has the interview letter, but before the interview date.

Look - you can rehome much with NVC on Monday. Call NVC, tell them that you are going to OPT IN to NVC Electronic Processing, and to watch out for the OPT IN EMAIL. You've already paid all the fees, so that's a plus - is possible to be finished by Friday, if you start on Monday.

After the phone call, send in the OPT IN EMAIL. You should get a GZO # within 24 hours.

Once you have the GZO #, send off the IV and AOS file sets via email.

re: the current police certificate. PCCs have a 6 month expiry on them, usually. Used to be a year. Now it's 6 months. Yer currently at 4 months timetick, so IMO it's useful - but - you want the white book version of that, and scan it to PDF file. You probably have a photocopy of it somewhere, so take that photocopy on sunday, and scan it in. Scan in the marriage white book as well, and all of yer tax stuff and the I-864, then again with the ds-230 stuff. scan it in. Be prepared to get a new pcc right prior to interview day, as there's a possibility that it'll expire by then.

Since your attorney is brain dead about NVC Electronic Processing - tell him:

--you're going to OPT IN to NVC Electronic Processing on Monday and

--send all of the casefile documents to you via email on Monday (or go by his office on Monday and retrieve everything he has, even all copies, telling him you'll return it all in a week)

now, what's up, you ask?

Specifically for GUZ IV, Electronic Processing at NVC is a godsend, as ONCE THE CASEFILE DOCUMENT INTAKE is complete at NVC, NVC schedules the interview with GUZ IV (is special hidden queue, no one that answers the phone at NVC knows about it) and the interview is set about a month out .

So, if you get 'case complete' by Friday, you'll get an interview scheduled the following week, for a month out - with a date sometime at beginning of November.

Look, it's on you to rehome the casefile, to make it an EP casefile at NVC.

I pray you do it, as 6 weeks vs 6 months is a big dealio, IMO.

Wow!!! Thank you so much!!! Last question, I did not get a request for ds3032 because when NVC receive the file. My lawyer was the point of contact. So they know that. My question is, if I call and opt in the electronic processing. Am I allowed to scan and fax all documents. In terms of the passport photos for my wife. I've read that it's a little tricky. Is there a trick to it. I've scan several doc, and the quality isn't so great. Will NVC accept these docs?

having the gs-28 in place doesn't matter, for nvc electronic processing, at all.

re: the photos - won't matter, as she has to bring in photos anyway. ya send in the scan, then bring photos to GUZ IV.

My lawyer does not do electronic filing, I don't know if I should just remove him or not. But I'm so scared of doing it wrong. On the AOS there's a lot of of documents. I provided all three years of transcripts all the transcripts are front and back.

At this stage, is a lawyer useful? It just seems like I did all the work anyways.

So if I e filing, I need a ds3032?
