k-1 visa lawyer-possible hard case

even for the cr1 we need the affidavit of support.. so is it really much different than the fiance visa?.. iI know wewould get by for 3-6 months without me working till iI get my residency so to do all that just to be able to work straight awayisn't really important or very viable cos I know we can manage till we can get me the green light to work

the main focus is the easiest and most likely way of me being able to stay over there so we can be together

In that case, K1 is the way to go: as you pointed out yourself, you will need a co-sponsor one way or the other, so your focus should now be on getting one: a family member or friend who is either a US citizen or permanent resident (they could reside anywhere in the US, doesn't matter what state). Don't give up hope, it's doable: you would not be the first or last person with a co-sponsor!

yea I think I need to feel the fear and do it anyway.. This visa is the best option I have I am pretty sure of that any other I have looked at just doesn't seem to be an option including work visas and such. If it gets refused I will just have to try another route. I will not give up.. i can't give up.. It isn't an option.. Just trying to be the best prepared I can be, and thanks.

There is no other viable route for you if you don't have the work skills to qualify for a work visa. . All will require an affidavit of support to get a green card.

If you can prove a bona fide relationship between the two of you things ought to go smoothly. K1 or CR1. A lawyer cannot improve your situation unless you are not able/willing to complete the forms properly.

Any US citizen or green card holder can be a joint sponsor.

You do have a few months to secure the sponsor, because it is only needed during the interview stage. You can start the petition and gather everything you need for that, because that will take some work too, and then after you can try to secure the cosponsor. It's a thought so you don't feel overwhelmed with everything. Just do one step at a time and you will be fine.

Lots of people use a co-sponsor, so you'll find lots of success stories on here if you use the search function.

As Anh map mentions, the I-134 affidavit of support won't be needed until the interview, some 6-8 months down the line, so file now and then start looking. Be sure to read the Guides here, several times, so as not to make mistakes and delay the process.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you all for your responses, links and help so far..We have been talking this through with each other and i have just found out that her gma is going to sign the house over to her.. is that enough as an asset for the sponsorship?..anyway hopefully we will be getting the petition sent off soon. need to get everything sorted for that first:)

Co-sponsorship ísn't a hard issue. Before you get into that, you need to file the I-129f, the petition for a K1. Just secure a co-sponsor while you wait for the petition to be approved. That's how you get the ball rolling :) . This can be any relative or friend of your fiancee who fulfills the needed poverty guidelines requirements. Most of what you need will be in the guides. You can also go to your regional consulate webpage to see if they allow self sponsorship.

hi, I have been with my girlfriend for three years and we are looking into getting a fiance visa. I would happily go through the process myself if i felt i wasn't going to bump into any problems. my main concern is that we probably don't meet the requirements for the affidavit of support.. We are both normal people but neither of us has enough money coming in to meet the requirements for this section of the visa.. i know that it wouldn't be a problem to go over there without this stupid money requirement and be able to stay with my gf and get everything sorted and get into work.. i have been over there twice for 3 months on the visa waiver and we have been fine both times and iI have stayed for the full duration..Do you guys think that a lawyer would help us to get through that step? can we get through it ourselves? thanks.. I'm also just really worried about getting refused

All you need is a co sponsor to sort out the affidavit of support issue. no need for a lawyer when you have VJ :thumbs:

Hei there, welcome to VJ.

The scenario you're painting is possible. Your fiancee is out of job and has no income. She is responsible for you(as an intending and upcoming immigrant, at least financially). When your fiancee can't show income, it's up to the embassy to determine whether or not you're likely to become a public charge, even when having a co sponsor lined up.

A lawyer doesn't come into the picture here because it's out of his/her hands because an embassy is not required to accept the i134(affidavit of support) however, wait until you receive feedback from nich-nich or people having gone through UK with this; they have greater first hand knowledge about that embassy than most others(including me - which means the rest of this post is generally speaking).

If the grandmother is willing to be a co sponsor(and later on a joint sponsor) if her income is enough, why not ask her? I'm assuming you'll be contributing to the household in the long run? I know it's alot to assume however it's also alot to ask for someone to sign their name on an affidavit even though most joint sponsors aren't affected by it but they have to trust you and they have to trust their guts that you won't claim any benefits on the no-go list for immigrants.

Plenty of grounds for not being eligible for a visa.. Nahh. You have a job right now, your fiancee has 3 kiddos. I think stay at home moms are fairly common in the US. But if you have no intentins on working in the future and the mebassy/interviewing officer catched on to that, then yes, how on earth will you feed 3 kids and a wife. I'm fairly sure they're entitled to take the grandmother out of the equation if they want to. While your job doesn't count in the affidavit of support, it still shows that you're not a public charge in your home country.

Adam- I agree with most of the people leaving comments.. Theres no point paying a lawyer. Save your money and get a co-sponser. When I was on my K1 journey, I hired a lawyer, and he just asked me to fill out my forms while he submitted them. And I would have to drive to his office and get my forms together. SO it was a waste of money. Especially when I had to get all my personal information together. When the case was not approved after the interview, I felt as though I threw my money down the drain..The lawyer could not do anymore except advise us to get married and go that route.
