previous b1/b2 refusal

HI everyone

i was refused a tourist visa 2 times a long time ago...once almost 10 yrs ago and 2nd time almost 5 years ago...i had applied it to visit family... my fiancee has recently petitioned for my k1 visa... i was womdering if any one with a previuos visa refusal of any kind has applied for a k1 visa... and would it affect my application in any way...plz share you ideas/experiences

The denial of the B1/B2 should not affect the adjudication of the K1 visa, provided they were not denied for reasons that would render you inadmissible in the US. If the reason for their denial was lack of tied with home country you should be OK.

The main difference being that on a B visa you were expected to return to India, whereas on a K-1 the presumption is that you will enter the US, marry, proceed with AOS and stay as a legal resident.

The denial of the B1/B2 should not affect the adjudication of the K1 visa, provided they were not denied for reasons that would render you inadmissible in the US. If the reason for their denial was lack of tied with home country you should be OK.

my past interviews were normal...its just that i was very young and like a lot of youngsters whom they deny visa to since there are high chances of them not returning to their home country..infact she even said you are just 19 ...you have a long life ahead and you can visit anytime later...I have a sibling in the us who is a citizen...the vo asked me if i had petitioned for a GC (in the sibling quota) ...back then i dint exactly know what it meant...may be the vo misinterpreted my reply...but i just wanted to go there to visit family and tour the country and ive never intended to stay back...any way...i hope my k1 process goes smoothly... thanks again!!!

As long as your denial was not based on fraud or other reasons that may cause you to be banned, you should be OK

Phase I - IV - Completed the Immigration Journey
