W-4 Question for Darcy

I wasn't sure where the proper place was to post this question.

I was filling out a new W-4 for myself since we are now married. I got to Question 3 where it asks for Single, Married, etc. I was of course going to mark Married and then I saw the note. 'Note: If married, or spouse is a nonresident alien, check the "Single" box. Then I tried reading the instructions as to whom is a nonresident alien and I could make heads or tails of it.

Is Darcy considered a nonresident alien until he gets his green card?

I was then thinking how should I have him fill out his W-4 when he starts work on Sunday. I saw this on the IRS's website.

http://www.washington.edu/admin/payroll/specialrules.html

So I am guessing if I deem that he is considered a nonresident alien he needs to fill out the W-4 as IRS has described. IRS states that he should mark Single regardless of marital status. It also states to write nonresident alien (NRA) above the dotted line on line 6.

Anybody have any insight on this? :help:

Thanks,

Jen

Jen,

Darcy is now a resident alien. He's not a Permanent Resident, but he is resident. Take advantage of it.
