Thank you Kiyah! I just got back from Morocco but it was the best feeling ever to know that my fiance will be coming home soon! :dance:

Oh I definitely know what your feeling...just wait until he walks out of the terminal doors at the airport and is in your sight! I swear I felt every emotion we went through during our entire ordeal all at once, it was a bit overwhelming and super sweet at the same time, a very emotional experience indeed. My sister had to drive us home from the airport, I couldn't do it.

There are a few others from the original group back in 2006 I know are still waiting, I pray they are reunited soon as well.

Happy New Year all,

My fiancee visa was denied December 30, 2009 at the Lagos Consulate in Nigeria. On the rejection letter it stated that it was denied because of immigration purposes. I contacted my senator in Washington DC, and luckily for us my fianee was invited for a second interview January 14, 2010 at 1pm. I sent him everything. I dont know what else they want from us. Very frustrating. Besides the lease to our apartment that i am sending with both our names on it, what can I use to prove a bonafide relationship.Help!!!!!!!!!!!1

First, congratulations on getting a second interview! I would provide as much as possible such as:

  • letters from family and friends addressed to the consulate who know you both and can attest your relationship is valid
  • letters from you both to the consulate stating your intent to marry, love for each other as well as addressing any possible red flags you might have.
  • proof of your visits to see him in Nigeria such as full passport copies, and boarding passes.
  • copies of emails, letters, cards, e-cards chat logs between you both and any family members
  • photos of you together and with family

The apartment lease with both your names on it may not be good evidence as he obviously resides in Nigeria. He is not lgeally bound to that contract as he isn't living in this country, even if his name is listed on the rental contract.

The reason for so many denials is that there is so much fraud. My fiance finally got his visa after waiting close to 4 years from his 1st interview!

wow finally you should have emiled me, BUT there is another side, ahmeds brother met this girl, they met etc etc...she filed visa....then they broke up....she never canceled....got back togeter and he went for first interview got it and is to return in a week to get the visa. Now how do you explain hardly no relationship compared to someone who has waited years?????

Hi everyone Hope u r all feeling loved and blessed . My name is miriam and i am really looking for ideas on our next step. My boo went for his interview on jan. 8 and was denied, on the white paper given to him it says they r returning our case because marriage for immigration. Now i have contacted my congressmen and my senator but both havent gotten anywhere so far. My boo's brother thinks i should go there and marry him, i however dont know if that will help or hinder us. When he went for the interview we had all kinds of proof letters, cards, phone records, emails, IM's and even emails between him and my sister and my oldest daughter. I know the CO asked him why we didnt marry when i was there and he explained to her that my divorce wasnt final and i wanted to be married here with my family. I went there in feb of 2009 my divorce was final in june of 2009 and we filed in aug of 2009, so how could i marry him and not go to jail. She also asked why would he want to marry someone my age (38-31) like im 20 years older than him. Anyway can anyone please advise me. Be blessed

hi, miriam. sorry for your situation. we are just finishing up being denied in 2008, the refile, and now we are on AP. so if you are determined enough, and your relationship is truly valid you will win :star:

with that being said, what were the exact words on the denial? go over all the questions that he was asked. were there any answers he was unsure of or hesitated to answer? you will need to know what went on in order to really get an idea of how to proceed. in our case, we were denied the k1 for lack of relationship evidence, including an engagement ceremony. then we had submitted over 1 year's worth of phone records, emails, letters, and cards. still it wasn't enough. when we tried to comply with what they were asking (to the best of our ability) they told us our case was expired and being sent back to uscis.

which brings me to another question. when does your i129f expire? if you filed with california, they will let your petition remain expired, and you are free to refile anytime. we opted to get married and file cr1 instead since the i130 does not expire. if you filed originally with vermont, then i would advise holding off the getting married part because i have seen where vsc will revalidate the petitions.

so with that being said, go over every detail of your fiance's interview to see what the real issue is. if it is a complicated case, then i recommend getting an attorney who is experienced in denials. make sure they can show you documented proof of their success. i know there is an attorney that will pop in every now and then, marc ellis. you can find him on vj as ellis-island. he is well-known for returned petitions.

Yes i will do that. Ill have him email me all the questions and the answers. I know he said she asked him to tell her about my childhood, he couldnt because i just havent told him about it like that and what was my hobby, she asked him my parents name he got that right and where i work. I believe they had issue with where i work because he answered i work for west at home and she said he was incorrect because i work for hsn, but they r both right. Im a work at home agent i work for and get paid by west however i take calls for hsn who is the company that pays west. When he told her my hobby was reading, she asked him to name the author, which he couldnt because i have never told him I always say a romance novel. But im gonna ask him tomorrow to give me all the question and post them on here. We also had plenty of info, yes we went through the vermont center

Petitions Returned to the United States

More and more this is how Morocco is handling visa petitions, and it does not matter the amount of proof of relationship you provide. We need a central place to review/share extremely important information to help ourselves and others going through this issue. Possibly even prevent this from happening to others in the future.

I will gladly create a legible, credible, and searchable compilation of all immigration guidelines surrounding petition return/revocation, research, etc. if VJ would commit to pinning this issue for us. Even if it is only in the ME/NA forum...PIN IT PLEASE?????

I am new to this site and don't know what pinned means, but if it helps, I am with you. My fiance received box checked other, and petition was returned to uscis march 31, 2009, they tell me to check back every six months.

Hello VJ Family,

The last time I posted a topic here, my fiancee was denied December 30 got a second interview January 14 and after the interview he was given a 221g to provide documentation on when I last visited Nigeria (Because we were addressing each other as husband and wife on emails, the CO believes that we secretly got married, so she insisted the he make photocopies of all the pages on all of my passports issued to me. I last visited Nigeria 1985 when i was 2 years old.)My fiancee was given an appointment date of February 22. So the question is providing that he presents the additional ddocuments requested will he be issued the visa or is there a chance that they may deny him? Im so scared. Please Help.

Honestly, there is no way anyone can tell you whether he will get his visa or not. There are too many factors, and every case is different. I can tell you that all you can do is provide what they are asking for. I do have a question though, is there any sort of documentation that you can provide from the Nigerian government that can prove he is not married?

Maybe this will help in addition to providing the copies of all your passports issued to you. I would also make he tells them in his interview that even though you are not legally married yet, you have considered yourselves husband and wife during your engagement period so you have addressed each other in emails, conversations, etc. as such.

My husband and I did this before we were actually legally married as well, it was in our emails and chat logs, but we made it a point to mention this in our letters which accompanied our original petition so this was not an issue for us at the USCIS or consulate level as we addressed it up front.

I'm adding my case to this list. My fiance had his interview on Jan 28. The embassy received his packet 4 on November 12 but didn't schedule his interview until after the NOA-2 expired on Jan 22. I emailed them and requested an earlier interview but they said no. At the interview my fiance was yelled at, publicly humiliated, and the CO denied him when he refused to change his answer to the question "What did your parents say when you told them she was divorced with three children?" At one point in the interview another CO came over (the female) and the two of them proceeded to question and laugh at my fiance. I'm now doing anything and everything I can to get a second interview. It's going to pose a serious hardship for me to get there due to family circumstances here but I'm going to do everything in my power to get there this time. I've emailed 4 senators, DOS, the New Delhi embassy, and am in the process of emailing Hillary Clinton, the Ambassador, possibly the president, and anyone else that I feel may make some small difference. The denial letter said that the NOA-2 expired and we did not have enough proof of our relationship. The standard BS just to torture people.

January 2009 - K-1 Denied by the consulate

January 2011 - Moved to India - Yikes!

October 2011 - DCF filing rejected by overzealous employee at the embassy

December 2011 - Tourist visa denied (not surprising)

March 2012 - CR1/IR1 process started

May 1, 2012 - RFE and some of our information was entered into the computer wrong by the CSC
