Hi there, well,yesterday I contacted both Florida senator and today I'm gonna fax them the Consent Form so they can inquire about my case, lets see what happens thru here, in the meantime, I just keep reading about K 1 Fiancee Visa regulation, and sofar I have not found anything that can show that a visa should be denied or potspone due to assumptions, on the contrary whatever the counselate has must be a fact or hard evidence, that they can show.

I will keep posting about my case.

Just make sure you follow it up. Those guys at the embassy think they are some kind of god and they can definitely return it on assumption just to be mean. Ours was returned because I guess they didn't believe our relationship was real, it has only set us about a year plus back in starting our family but they have been put to shame. You'll be alright.

Hey, We have been returned also, April 28, 09. I spoke with USCIS and NVC, Monday, neither place has our case, or so they say. I spoke with my Senators office yesterday, they were calling today to USCIS to see where it is. My case worker at the senators office told me 2-4 weeks for the case to physically get to US. Well its been 6 for us. So we wait for the call again. This is so frustrating.

Hey, We have been returned also, April 28, 09. I spoke with USCIS and NVC, Monday, neither place has our case, or so they say. My case is back with USCIS I guess was fast because I been calling everyday and went to my Congressman and Representative, today I called the department of state and they told me my case still in Madrid and to send by fax more evidence, the visa specialist gave me the fax number she was very nice maybe because I don't stop criying and just right now I got this.

Well - as you all know - I am/was dealing with a returned K1. I changed my address via the AR11 form and guess what shows up in my mailbox??????????

REAFFIRMATION NOTICE

That's right - the CO and his no bonafides my a$$.

Anyway - in an attempt to go on with our lives, I gave notice on June 1, gave up my apartment, and bought a 1 way ticket to Delhi leaving next Sunday.

Damned if I do - damned if I don't...at least I have assets in place for the affidavit since I no longer have a job!

CONGRATULATIONS!!! I guess we are in the same boat as we just got our own reaffirmation after about 18 months, and we didn't get asked for additional evidence which means the CO definitely didn't have any evidence for whatever allegation he hd levelled against us. Good luck with the rest of the process but try have a co-sponsor for the interview stage. All the best.

This is good news....but poor timing! What are the chances of getting your job and apartment back? You will need to be able to sponsor him. Perhaps you could change your ticket for his interview and purchase 2 returns. :thumbs:

Thankfully I have enough in cash assets to still sponsor him...

No chance on the job [volunteer layoff do to economy] and with out the job no prayer in paying for the apartment.

Just the most wacky timing EVER. I was completely prepared to go DCF - even wanted him to have the greencard on entry...

Still sooooooo shocked.

Just need to pick the brains of those who have had returned petitions reaffirmed please; My Fiancee called NVC and according to their system our case is still showing up as being returned and they have not received our file and it's almost 3 weeks...we are now getting a bit paranoid about the whole thing. Why would USCIS be holding on to the case for so long? BTW, my fiancee has received the reaffirmation notice from USCIS. Any advice would be very welcome. Gracias!

Our returned petition took a lot longer than our initial petition did to get it back to the NVC. I called the USCIS and they told me that they had sent it quite some day prior, but the NVC claimed that they hadn't received it yet. I requested an inquiry from the USCIS on the date it was in the mail, but that got me no where. I suspect that the petition had been at the NVC for some time, but since it was a returned petition it required additional processing since it was considered a possible fraud case. It wasn't long after that they had it. Even someone at the NVC told me that it is possible that it was there, but just hadn't been opened yet.

Perhaps your representative could assist you in finding it.

Just a quick update. Our returned petition has been "touched" today. The note online has not changed, and still says they received our petition with a request to review. In our new I130 petition, I referenced over and over again our previous petition. I wish they could link it by social security number or something. The NOA1 for the I130 is June 29, but has not been updated since June 30th (probably just to send the letter). K1 is now null and void, since we are legally married. I would like to know what the "touch" means. Should I call and try to link it, or just wait?
