he is trying to check to see if there is anyway around this 30 day wait, then I will return a married woman. If not, then I will make another trip for marriage. 09/09/09 is looking really good, lol.

In Morocco you can get anything if you just grease some palms....lol

I hear ya, same goes in India (which is what he is thinking). I told my SO don't get used to that, lol. One website I was looking at said either the bride or groom has to have a 30 day residency. Another website said you have to submit at least 30 days. So I am wondering if I give my SO a copy of my birth certificate (I have already picked it up) can we turn in the info while I am there, and come back beyond the 30 days and get married, or is 30 days the maximum, in which case, he will have to turn the docs in before I arrive.

this is ridiculus :unsure: , almost 14 months now since our i-130 petition was returned to uscis for review

i learned from these postings that writting to office of ambudsman would not help, so i'm not going to do it

since they can not disclose the reason for denial

waiting is killing me, i've read through many denials, but still people got their NOR/NOD within 6-9 months maximum

what's going on with my case? :angry:

... for me noone is telling me anything... ok so here is my case i got married in Jan 2007 and filed for my I 130 in April 2007 ( i should not have waited 3 mo to file but i thought it would be better ) and I filed I 130 spousal visa CR-1

.... ok so finally my petition is approved from USCIS and NVC by May 2008 and they sent over the case to Bombay (wrong consulate) they reschedule our interview at the right consulate, Delhi. My husband went for his interview in July 2008, after the interview they gave him a 221g AP for more proof such as a family tree, addresses and phone numbers of all relatives, guest list, emails, phone records, voters card ok so we sent them everything to the VFS office with his passport. They sent back his passport with no visa. They said its in Administrative Processing....

its been 7 months and still no word. I went to my Congressmans office and they gave me the same response. I call DOS and they give me the same response "221g administrative processing, etc"

I went to a lawyer and the lawyer said theres nothing he can do for me.... I cant file for the fiance visa because they will reference this case and it will be the same problem....

I have went to India 3 times and Im going this 4th time for 6 months... the first time i went was for 3 months second time was for 5 months and the third time was for a month and now im going to 6 months.

what else should i do ? im soo sad....

Does anyone know what i should do now besides wait?

I just pray to god he will get me through this... Inshallah

It doesn't sound like you are in the same boat. It sounds to me like you are in AP, which is pretty normal, and unfortunately there is no set time in completing this. Abed's was denied. very different.

Abed, I know this is hard, and I sympathize with you. Ours took almost 4 months to get to from the consulate to the USCIS after his interview. Then almost 8 months before they even picked up the file. They sent us the NOIR at the end of July and I had the rebuttal sent back within the week. The reaffirmed the case within a couple of weeks after receiving the rebuttal. The interview was scheduled 2 months later and he got the visa after another month. So a total of 15 months. And this was considered fast.

What service center did they send it to? Do you have a representative that is helping you? Have you prepared a rebuttal?

our petition lasted 5 months between DOS and NVC before they forwarded it to uscis califournia on december 12 2007. my senator made 2 inquieries on my behalf, but the result is just standard answer

they can't tell any reasons nor predict any time lime. i havent prepared anything yet but i guess i have enough

evidences in my side, recently i made a visit to my wife in morocco and still exchanging emails and phone calls

i dont khow if they can consider that visit as proof of ongoing relationship. who khowns. god only khow

Please ask your senator to check on the case every couple of weeks or so to see the status. I know that they can't do much more, but maybe they will get tired of them and get it over with. At least the CSC is faster than the VSC. Don't give up hope, and yes the more trips you visit the more it proves an ongoing relationship. You need to have an entire packet of proof to send them when you get the NOIR, and they only give you 30 days to respond, so hop to it and get it pulled together. It could be any day...you just never know.

Thanks 100000000000000! To kiya and all of the others that are putting information in here to help us. I have done osm eof the things that youve posted here. I know you can understand how helpful it all is. There is not a day that goes by where I am thinking to myself, is there something more I should be doing.

I emailed the DOS, or composed the letter for the FOIA, and they told emailed me back saying that it is a 3rd party request since it was about my husband. So he wrote a letter, mailed it to me giving me consent to request any infromation about his case. Am I missing something with this? I havent heard anything back yet.

I gotta say, that diplomatic pouch thing is for the birds!!!!!!!!!!!!!! No wonder it takes so long! :angry:

i recived letter from uscis that they recived my petition back from dos for review. and they reviewin my case if they will need somthing they will conatct me.

i wan ask wt is deffrience betweet review nd revocation. i read u post. about noid/noir.

when they send noid/noir

my sanater checked embassy gt reply they sent case back because of relationship.

wt can i do now. embassy keep all documents

Perhaps you could call them back and tell them what the e-mail stated and what the online status is, then perhaps they will let you talk to an immigration officer. Hopefully the e-mail is correct and they just didn't update the online status. It does sound hopeful, but I would hate to see you get your hopes up for nothing. They really are inept there.

It does sound like they are preparing the NOIR ( Notice of Intent to Revoke). This will be your opportunity to present your case. They usually give you 30 days. Do you have your rebuttal started?

For those of you who remember me, you all told me not to refile until USCIS ruled on our first case; I ignored that advise and followed my attorney into unknown territory. I filed a new K-1 and my husband is here now!!!!!

Desperate times call for desperate measures.

I'm still waiting for USCIS to respond to my rebuttal of our first K-1 denial from April 2007.

I sent them everything in January 2008. My case is STILL pending.

Morocco is probably hip to this, so refiling there with a pending petition won't work, but it may work at other embassies where the fraud isn't as much of a problem....and I would advise ANYONE working with another consulate that is not a high fraud post to REFILE!!!

It will be interesting to see how long USCIS finally takes to rule on our first petition.....we originally filed October 2006. If I had waited, I probably would have jumped off a roof somewhere by now. We got married in September of last year and I coudn't be happier.

NOA 2: 04-02-2008-->SECOND Petition approved

07-31-08- Entered the U.S.

09-17-08- Married

10-29-08: File AOS, EAD, AP

01-15-09: EAD Approved

02-26-09: Biometrics Appt.

03-07-09: EAD card received via mail

03-20-09: AOS approved

03-28-09: Greencard arrives via mail

Hi, congratulations first off. What was your first K1 sent back for? What steps did you do to resolve? We were considering re-filing for a K1, but now are leaning towards getting married in September and filing for CR1. Your input is greatly appreciated, as you are the first K1 I have heard that refiled a K1 and received a visa. Very intriguing. :yes:

ok my name is erika my fiancee was denied yesterday for our k1 pettition the reason was the daughter that we thought was his and mine came neg ,they made us do a dna test on our first interview and i did and the test came neg know they gave a second interview which my boyfriend went yeterday they didnt give him a chance to say anything and they just told him te denied the pettion know i want to fight this cus regarless of the test our relationship is true and in our hearts and to all my family and his that is his daughter ,know ive been reading i already send a letter to nvc inquiry what else can i do it still in bogota colombia i need much i will appreciate
