u got some kind of paper back to explain,usually the 221g with further explanation needing more reveiw etc what does your paper say, and how exactly was it worded, a return for review could be one thing, a review for the normal name checks etc would be another

We got the 221g, and it was worded that it was sent back to the CIS for further review. So anytime I hear sent back to CIS (USCIS) it is a sign to move quickly. Maybe you didn't get the 221g, but if that is what the DOS told you then you need to get more info quick. Perhaps they are wrong, they have been before, but I wouldn't wait to find out.

After the interview what did they give you? They must have given you something. They are required to either issue the visa, give you a hard denial, or a soft denial. The 221g would be considered a soft denial, and it can mean many many things to simple AP to sent back to USCIS.

They said for him to return with a piece of information, and then he would get the visa. So, he went back to Erfoud, (16 hours rndtrip), got the information and returned to the consulate, whereupon they told him that he would not be getting the visa, that this is how it works, despite my fiance stating what was told to him. They then went on to ask about more information, and then it went to Administrative Processing. It came back from there, and we DID get the 221-G after all (I went back to check my paperwork), and were told that the visa was going back to USCIS for further review. He was also told that his petition had expired in CASA, but no paperwork about that.

Maybe you could call the DOS and try to get some information from them. I know if the security checks cleared then its up to the embassy to issue the visa. But if the security checks dont clear then the embassy cannot issue the visa. Do you think it could be something with his security checks? Just a guess.

you are talking about 2 very different process's here.

the 221g has several box's on it. each box has a different meanings>>>>

one is call AP which is sending your case for name/security checks to washington---after checks are complete a visa is issued.

the other is returning your case for further review by uscis---this is a DENIAL to issue a visa. your case goes back to uscis and it is anyone's guess as to what will happen next.

if the consulate is going to issue a visa they can extend the validity of the petition so it doesnt expire. so no need to be concerned.

you need to find out exactly which box is checked on the 221g letter. then you will know what needs/can be done.

it DOES sound like your case has been denied a visa and is being returned to uscis. you need to know for sure though. have you e mailed the consulate and asked about your case? have you asked your representative make an inquiry via e mail?

these would be the next steps for you to take.

the application goes back you do not have the visa yet, ok this is what mine also said going back for REVIEW to calif and ours had also expired. It was returned to calif the month it expired and died there. They told me to refile.......and they will send u letter saying they have recd it but in over a year they say nothing, only thru my rep finding out about the refile. IF it is returning they should be able to give you the pouch number it is to be returned in....but you need to try keep it there if possible. But first you HAVE to find out exacly what is takeing place with your case

Everbody suggests you find out first why your petition got returned in beginning. Call rep, send in privacy act notice. I would like to know kiya did you find out? Or did you reapply? Shoni did you find out? Morocco did you find out? or just guessed? Brnidokiegurl did you reapply too?

My question is, why do so many people on here that never had thier petitions returned suggest you find out what is the reason in first place why it was returned? They dont give you reason as far as I am concerned. You will be waiting for life time? What is wrong with reapplying?

The only reason they initially gave us that they doubt the validity of our relationship. On the NOIR it stated 3 reasons. Just met and married (we had known each other almost a year before I flew there), We had a small wedding (we only got the approval 4 days before my return to the states, hardly time to plan a wedding. There were no relatives at the wedding (a lie, there were family, they never even asked who the people at the wedding were).

But I was one of the lucky ones because the interview was going fine until they asked if he had family in the US. He said his sister and ex brother in law. The ex was from a different sister, but they came to the wrong conclusion and assumed that the 2 in the states were the ones married. They then asked questions about the first time I talked to his sister, and if she arranged our marriage. So we knew the reason even though they never stated it. But you are correct, most of the time they don't tell you.

On the other hand it is good if you can find out, or if you can figure it out. It is hard to fight if you have no idea.

Hola todos.....gracias a Dios los encontre a ustedes, yo pense que solamente a mi me habia pasado....les cuento, soy visa K1, colombiana, el pasado 15 de julio fue mi entrevista en la embajada de Colombia y tambien fue negada por falta de evidencia familiar, cuando la boba de la consul no se tomo la molestia de mirar las evidencias que yo llevaba......y el caso fue devuelto.

Ahora estamos a la espera de que mi prometido reciba la tal carta, ya ha llamado muchas veces pero nada que le dan razon.........ls agradeceria que ustedes me contaran sus experiencia, para saber ahora que debemos de hacer.

I don't think we can help much unless this person has someone who can speak english. Then they need to study this thread well and contact their representatives.

makes no sense!
