Hi everyone,

I am currently in the process of filling out form I-765, however, I do have a question on one matter... I have no idea what my current immigration status is. It asks, "#15. Current Immigration Status (Visitor, Student, etc.). Here's my story:

I came to U.S.A. on a F-1 visa, and a week after my college graduation, I got married to my American girlfriend. So what is currently my status? Would I be still considered on F-1 status, even though I don't go to school anymore? I mean, the last time I entered the U.S. was on F-1 status... but what status am I in now? Thank you for any responses!

It's my understanding that you have a 60 day grace period after you finish school to leave the country. I guess if it's still within those 60 days you are still F-1. Otherwise, you are out of status.

You'd need to check that, but that was my experience with my husband.

Day 0 - 2 May 2012 Mailed AOS package overnight delivery
Day 139 - 17 September 2012 Interview & APPROVED on the Spot!! :)
Day 145 - 23 September 2012 Received Green Card!

ROC - Eligible June 19 2014

Day 0 - 18 June 2014 Mailed ROC package via 2 day priority

Day 42 - 29 July 2014 Approval and Card Production Email

Day 49 - 5 August 2014 Received Green Card

Even if I am still in my 60-day grace period?

It's my understanding that you have a 60 day grace period after you finish school to leave the country. I guess if it's still within those 60 days you are still F-1. Otherwise, you are out of status.

You'd need to check that, but that was my experience with my husband.

I am still in my 60-day grace period. So my understanding is that his situation was the same as mine, and you considered your husband as F-1 when he was still in his grace period, and you didn't experience any problems in the filing process for his green card?

If it's still the grace period, you are fine. But submit that application ASAP! :)

I am still in my 60-day grace period. So my understanding is that his situation was the same as mine, and you considered your husband as F-1 when he was still in his grace period, and you didn't experience any problems in the filing process for his green card?

If you are still in your grace period, then obviously the answer is NO, you're not out of status. Then you are in F1 status...I was not aware of you being in your grace period. All the best!

They want to know how you entered the country. Put F-1 or student. They will figure out whether you are out of status or not. You can be out of status on every visa, so "out of status" is not descriptive enough - it's not the answer they are looking for.

2/06/13: APPROVED!
