I have a friend who is willing to fill the affidavit of support for my husband. Now my problem is she is married, but her marriage is not going so great she decided to file for divorce. Now I am wondering if she has to include him as a part of the house hold member, he doesn't live in america nor has he ever live in the united state she was working on his paper work but she doesn't want to continue the relationship. so please help me figure out if she has to mark that he is married which includes him as a part of the household, with him on the affidavit of support makes the income not meet the poverty line. please help ASAP!!!!!

She counts the husband in her household count. As long as the marriage is valid, she counts him.

She can only stop counting him when her divorce is final. So until she gets a final divorce decree, she is still married and still counts her husband.

If she adds him as a household member and wanted to combine income the husband has to file 1-864A and he needs to sign it and accept the joint responsibility.

The husband is counted in the household.

He cannot file an I-864a because he does not meet the requirement of being a US citizen or LPR. The OP stated that he has never live in the US and his wife was working on his papers.

Find another joint sponsor. This one has some marital and financial baggage to deal with, as well as a history with USCIS.

05/01/2013 - Removal of Conditions - APPROVED!
