Has anyone here used a lawyer for k1 visa?

I AM a lawyer and I would say you do not need a lawyer to fill out the documents -- so long as you can comprehend everything. Now, this is ironic coming from a lawyer!!!! :lol:

01-06-07 Called Embassy and received interview date of January 19, 2007.

01-19-07 Visa approved (I flew down for interview)

Has anyone here used a lawyer for k1 visa? Is it better to use an attorney? Is it faster to use a lawyer?

We didn't use a lawyer and we had no problems.

Some people who did use a lawyer have experienced delays because the lawyer did not forward paperwork(such as a request for more evidence) to the client in a timely manner.

Unless you have a complicated case, you are much better off filing your own paperwork.

Hello,

It is always better to hire a Lawyer to keep your case in safe hands. If you do not follow the process corectly it can amount to enormous delays and hassles to bring your fiancee to the US.

As you can see, many people disagree with that comment. A lawyer doesn't guarantee your case will be safe hands - they can and do make the same mistakes regular people do. If you read around a bit, you'll see people whose lawyers did not send in the right information, held RFEs for weeks, do not send the correct payment, etc. If you feel confident filling out forms and gathering all of the necessary information, and your case if straightfoward (even if it isn't, if you are well informed), there is usually no need for a lawyer.

Your caveat is significant. The anecdotal evidence here a VJ is that many people do not.

I used a lawyer and only experienced the same delays everyone did. But, I had a very experienced immigration attorney. It depends upon your finances, desire to read through the regulations and guides and whether you want to deal with all of the paperwork. My attorney was very specific about what I needed to provide them. All I needed to do was sign documents, get a few notarized and pay everyone's fees.

I would recommend using only an experienced immigration attorney and not just someone that is an attorney. But, the ultimate decision is yours. Your attorney does not need to be in your local area. Mine was in the midwest and I'm on the west coast.

We used a lawyer as we are both busy, and since most of it is on my fiance and he wanted to make sure all was well that was fine with me. This did cause some delays as the lawyer is in VA and I am in Ontario so b the time I got my Packet 3 from their office it was almost 10 days wasted. I am not unhappy with using a lawyer, just not sure I would do it that way again since I found VJ now.

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

I dont really remember. I looked at so many advertisements that was on google and yahoo. You can find them in any search. I did not go with any of them though. Mostly because my case was not straightforward and i wanted to make sure that my fiancee gets help for herself in Morocco. The consulate there is very bad and we want to avoid the hassle.

I have filed a couple of cases on behalf of myself and other family members from K1 to Citizenship and all cases in between. My only qualification and the reason why these family members approach me?

Meticulous! Border OCD in f/up!! Bull-dog like tenacity!!!.. and nowhere near a law school.

Oh and lets not forget a deep disdain for waste of funds when they can be channeled into other uses.....Darfur calleth!!!!!!!

But why bother................you have already hired an attorney, so whats the fuss? Peace of mind, albeit temporary as so many have attested to, whilst using an attorney can be priceless.

We used a lawyer, I just felt better knowing that someone who has done this beofre was looking at our papers. Keep in mind a lawyer is only as good as the information you tell them. If you use one dont leave details out that could bite you later. I am happy that we went with the atty. But I did and still do stay on top of everything at all times.

We are using a Lawyer. It doesnt make the process any faster really..just makes is a little less overwhelming. Basically they make sure all the T s are crossed i are dotted that sort of thing. It has it positive and negative aspects...we really just needed someone to give us direction on where to being.

As an attorney, I can tell you that unless you simply do not understand the paperwork regarding the K1 Visa, you do not need an attorney to fill this out. You do not get "bumped" to the head of the line. An attorney is good in the immigration context if you have "legal" issues. However, in reality, with a K1 there are no legal issues. If you get denied and then need to appeal, an attorney may be helpful with the drafting of your appeal and making it look professional.

However, the basic documents required can easily be done by the lay person. But, again, if you do not have the time to fill out the documents, then a third party could be helpful. I find it difficult to swallow to pay somone a $1,000 plus to simply fill out papers that can easily be done by yourself.

Do not get me wrong, attorneys serve a significant purpose in appeals, hearings, etc., and because we "know" the system, but at this venue of the process you just do not need one. Stinger.
