Has anyone here used a lawyer for k1 visa? Is it better to use an attorney? Is it faster to use a lawyer?

I think I was late filing for AOS:

07/27/07: Mailed AOS papers to Chicago mailbox.

08/02/07: AOS papers received in Chicago.

Unless you have unusual circumstances I think the overwhelming majority will say it is not better. A lawyer can do NOTHING to speed the process and sometimes they simply get in the way. If you read the guides here and ask a few questions you can do it yourself.

If you are prepared, I dont see how a lawer can speed up the process.. also I would only use a lawyer if you are not comfortable filling in the forms or if your case is not straight forward

Used Lawyer: It depends! How complicated your case/situation? Yes people use lawyer various reason, majority of VJ people don't until their case get stucked somewhere in the process.

Better to use an attorney: It depends! Money, level of comfort, too lazy to fill out a few forms and post 1000's questions on VJ, then YES, it's better to have a lawyer. I personally had an immigration attorney who filled our forms for us, because I didn't find VJ after I sent in my I-129F. So, it WAS better for me at the time. For you: I don't see how it is better when you already found VJ :)

Faster to use a lawyer: compare to what? I would say 99% of the people with simple cases will say: NO WAY. People with "issue" would say: using a lawyer to guide them through the legal trail was the best idea.

My vote: no lawyer, when you already got Visa Journey. Unless your fiance is in trouble with the Laws.

Thanks for all the quick replies. I saw some advertisements by attorney who say they can make timelines shorter. I was curious how they can do this and if anyone else had experienced this.

Yeah there just might be able to if there satisfy the following conditions

1. He works for USCIS which means he approves your petition.

2 He also works for NVC which means your case gets transfered directly from his office to the embassy.

3.He is also the CO at the embassy where your fiance/fiancee would be having his/her interview,and also oversees the administrative aspects of the workings at that embassy which would help you a great deal in getting out packet 3 and scheduling an interview date.

BELIEV ME IF HE MEETS ALL THIS REQUIREMENTS THEN BRAVOOO, I'D SAY GO FOR IT!!!!!!!!!!!!

I used a lawyer and have had a speedy approval. Probably because the paperwork was complete and arranged in good order. IMO they process these cases faster.

I have a somewhat complicated case and I went the middle route. I found a great lawyer who offers to do all filling out and filing of the paperwork for you for over $1000 or who will look over your papers for you after you fill them out to check for errors for $150. I went for the $150 option and it gives me some piece of mind knowing my paperwork is correct and that I have someone who knows my case to fall back on quickly if something goes wrong. She also answers email questions anytime I need her!

In the beginning we are lost about all forms and proofs, then was nice to have an attorney but now I think we could do all process, we only need time and patience

Our attorney forgot to send the divorce decree and we got a second RFE. :angry:

Other thing: an attorney can't get informations from Immigration, the same way like us. We asked the help from a Congressman and Senator. We got NOA-2 approval almost 7 months before NOA-1. All process was hard on us and now we are waiting NVC to receive our process from CSC, yet. :crying:

I asked myself this same question. But luckily I found VJ before filing in the paperwork. Also, my case is pretty straightforward with no complications, no previous marriages, no children, no other trouble factors:visa overstay, entered US illegaly, etc. Decide based on how much money you have for a lawyer and if you're willing to spend the time to fill out forms, etc. But this site is truly the best and you will find the answers to all of your questions here. I would have to disagree with you ... The lawyer has nothing to do with getting your case processed faster ...

The only reason why someone might get a faster approval than someone else would be the fact that they had an more organized package and weren't missing anything requiring a RFE ...

Obvioulsy if you get an experience lawyer then they will put together an organized package and would make sure nothing was missing which defends what I said above ...

Basically as others have said, If you have a straight forward case (no crimal records ect.) and feel comfortable filling out the papers and asking questions on VJ then you should be fine ...

We started with a lawyer and realized it was a waste of money and time and was able to put together everything needed in a more timly manner than them. I found VJ afterwards so I did the AOS myself.

As long as you check everything this can be done without a lawyer

K1 Visa

June 15, 2005 - Submited I-129F

June 29, 2005 - Received NOA1

July 09, 2005 - Received NOA2

July 19, 2005 - Package 3

August 18, 2005 - Package 4 with the interview date (october 17, 2005 in Rio)

September 6, 2005 - Medical exam done

October 17, 2005 - Interview date APPROVED!!!

December 2, 2005 - Arrived in the U.S.

December 8, 2005 - MARRIED!!!

AOS

December 23, 2005 Sent completed forms for AOS

Jan 2006 - Checks cashed for AOS

Jan 06, 2006 - Received all 3 NOA's

Feb 16, 2006 - EAD and AP approved

Feb 24th, 2006 - Received AP in the mail

March 18th 2006 - Still no biometrics letter, made infopass

April 11th 2006 EAD Biometrics

April 18th 2006 Received EAD in the mail

May 10th 2006 AOS Biometrics after calling 800 number for 2 months, they claimed letter was returned undeliverable by the post office.

May 25th case transfered to California Service Center

June 5th case received by California Service Center

June 14th - Email that a Greencard was ordered (no interview)

June 17th - Welcome letter comes in the mail

June 19 2006 - Greencard arriives in the mail - WE ARE DONE!!!

Sept 2006 - Passed the road test

October 2006 - First job in U.S.

March 2008 - File I-751 - Biometrics taken

Naturalization
