Any particular reason why?

Also Do you have any better advice to bring her to USA?

She has been refused twice before was my first clue.

Get married.

If you are planning on marrying her than you should do what your lawyer said, although I believe it's an O-3 visa you will be applying for, not an O-2.

If you want more time together before marriage then try for the B2 visa. She does not need an invitation letter, they are pretty much irrelevant. What she does need is to show strong ties to her home country. If she does get the B2, she will want to return before the 6 months is up, any overstay may hurt her chances for an O-3 visa in the future.

Thank so much. Yes O-3. you are, right.

You advice seems the best. 6 month is enough to me to marry with her.

I want to ask another question for you.

Just in case she was denied for her us visa. How long dose she have to wait until she try to apply next time for US visa?

Thanks for the reply

That time she didn't have much money but now she has more money.

That why I thought she has more chance to get a visa. Also the last try was i think already more than one year ago.

I just found this forum

US embassy in Chisinau

This is kind of sad and kind of mad for me.

She is not a prostitute! but she is single and 27 years old.

If this forum is true most girl under 35 will be denied in high chance in US embassy in Chisinau.

Yes I will planing to marry eventually but I need her to be USA first.

Or are you saying i should go over (Moldova)to merry her?

I was reading some article about marriage with tourist visa.

Some people says it's could be really dangerous if there is any intention of marriage at beginning.

We could be deported!

I mean this seems make sense because of fake marriage or something but I'm not planning to do some thing bad. We love each other.

I'm just busy. I have a job every day in USA and i don't have time to go to Moldova or Japan for just marriage process.

She wants to come to USA to stay with me. What is wrong? so first i want to bring her to USA somehow.

She can apply the next day, but unless something changes to convince the CO that she should be approved this time around, then you will more than likely be wasting your time and money. To answer your other question, yes there will be a record of her attempts to get a B2 visa.

From what I can tell of your situation, if you're sure you want to marry this woman, than that seems to be your best option for getting her to the states with you. It may also be a lot easier and cheaper in the long run for you to go to her country, get married and then petition for her to come here on the O-3 visa. The B2 visa appears to be difficult if not impossible for her to obtain.

But since she has an immigrant intent, she might have problems with getting a tourist visa.

Use the right visa if you want her co immigrate to the US.

That's all.

I recommended to my girl fried to apply for F1 visa (as ESL Student) instead of B1 visa.

Dose it makes situation better or easier?

Since reading many visa articles, Marry with tourist visa could be dangerous.

A long time ago when i applied F1 visa i also had about 15k of saving.

I'm thinking getting F1 visa shouldn't be so hard.

Why do you think that?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Why do you think that?

Because with 1F (Student status) to go to study ESL at school seems reasonable reason to stay long term.

Also easy to convince why she wants to go to USA. She can probably tell an interviewer she want to improve her English for her job or expanding her career in Moldova or such.

Studying ESL is one of the most conman reasons why none English speaking people come to USA for. And afterwords they can go to a college if they want to stay longer.

I started my USA life with F-1 and had kept the status almost for 10 years, and I switched it to O-1. This was compliantly regal.
