Hello Everyone.

It's getting closer to the time that me and my fiance will be starting our K1 Petition.

I am travelling out for christmas from the UK on my B2 to spend 2 weeks with Amber.

During that time we are going to put the paperwork together for the petition.

However i have a question.

What would be the best course of action for sending the Pack off. Should we wait until i have returned home before filing it or will we be ok sending it whilst i am still there.

I know on the I-129f there is a section on is your fiance in the US at the moment.

If we send it whilst i am there will will that increase any chance of the petition being denied or will they realise that my I94 has been handed in at NEwark airport when i leave around a week after filing.

I would send it when you get back to the UK. Main reason being is that because you need that 2 year requirement proof, its always good to have too much evidence than not enough and include your boarding passes/stamps from that trip too :thumbs:

I was in the USA with my fiance and we did all our paperwork there(to get original signatures and stuff), went home(to AUS), copied my boarding passes and passport stamps and sent back to him then he filed. Plus we weren't too sure about that "currently in the USA" situation on the I-129F either, so we waited until I got back home because we didn't want to mess up the application somehow by writing something wrong in that section :P Stayed on the safe side haha :lol:

August 29th, 2012 - NOA1 Received via. Email(hardcopy about a week later in the mail)

Send it while you are still here in the US.

That area you refer to, is precisely for situations like that one. Complete the form with the information it requires from your i-94, and that's all.

We filed while I was visiting in the US.

I don't know what your circumstances are, but since you didn't mention anything about coming to meet your fiancee, I'm assuming you already know each other face to face. If this is your first face to face time, it'll still be ok for you two to send the petition in.

Yeah we have met face to face on a number of occasions already so the proof of meeting shouldn't be a problem.

I am in a similar situation. My fiance was home in South Africa when we filed the original 129F. However he is currently on a C1/D crewmember visa as he has a 6 month contract as a cruise ship chef. He also has a 10 year B1/B2. Is there anyway he can file for the K1 from within the United States?

I'm sorry but I don't follow..

So you filed the i-129f already. What do you mean file for the K1 within the US?

The original poster has not filed the I-129f yet, and was asking about doing so while visiting his fiancee by the end of the year. THAT can be done.
