An ironic twist

That's right, ladies and gents, I am the poster child for "don't mail your petition while still jet-lagged!" And yet, since the I-130 was rejected suddenly I don't have to request my petition to be cancelled without prejudice if we go with DCF! (God works in mysterious ways . . .)

An explanation: I wrote the check out for 190.00 in the lovely little box, but when it came time to write out the numbers long-hand on the second line I wrote it for One Hundred & 90/100's. (Did that on a rent check once too, Landlady thought it was funny and just asked for the remainder. Bummer Homeland Security doesn't do the same . . .)

The result is all of my petition, including the check and photos, returned to me via the mail courier with a lovely I-797C stating Rejection due to insufficient funds. But hey, at least this time I would resubmit directly to CA rather than the farce of sending it off to Nebraska to have it forwarded!

So . . . I'm seeking advice on this one. Shall I re-write the check, tidy up the petition, and re-mail it with all of my newly acquired information on doing this correctly, OR do I stick to DCF and not worry about filing here in the States at this point? Suggestions?

(And, man, do I feel like an idiot right now . . . I hope my husband forgives me on this one . . . although, I'm sure he's laughing in good Aussie fashion right now . . . sigh . . . what else can you do? Beer, anyone?)

We had, but this sort of confirmed it. Okay, this REALLY confirmed it. Oh, and my sweetie forgave me no problem for the mess up. He also doesn't doubt the DCF now. :D Life is suddenly so much better than it was a week ago!

Oh! And I just got a response from the Consulate -- they're putting the pckt in the mail tomorrow. Yahoo! They did say that I have to file the I-130 and the 864 in person on a Thursday before the interview? I thought we could do it in one day, but if that's not the case we'll work around it.

It's definately a sign to DCF!

We have our interview in a week and a half and plan on submitting it all in the one go. I thought we all had established that this was acceptable? Damn woman don't freak me out! I'm in a delicate condition here! haha

I don't know, I'm just sharing what I got from the Consulate. If you didn't get that in an email from them, don't listen to me!! (And do please tell me once you're done that you really can do it that way!)

Here's what I got:

"Thank you for your email.

Our office will mail you packet 3 in tomorrow’s mail. Unfortunately the I-130 and the I-864 must be filed in person by the US citizen on any Thursday morning prior to your interview."

Everyone else is saying it's an all-in-one-go sort of event, which of course I would prefer too. Any words of wisdom out there? Anyone else get this sort of email in response? I did use exactly what was posted by, karo, I believe, when I sent the original email. They may be changing policy for those of us asking for it more recently?

BTW, AussieAmerican, I read your post on the other topic, I'm sorry to hear about your daughter's ####### of a father. Lots of positive energy your way that he thinks of her first and lets her be with the family who adores her. And major congrats on the new one on the way!!

Thursday's are walk-ins. You can do it all at once at your interview date....or turn it in on a thurs walk in - and then you don't have to be at your hubby's interview.

i'm doing the first way....and leaving to do it in SIXTEEN DAYS :) :) :)

Finally finished with immigration in 2012!

Mmmm... or maybe they changed it for new applicants?? Caroline I wouldnt worry too much, but maybe they are trying to make it go faster the day of the actual interview. Who knows!! You could always send them an email and see if you can do it the alternate way!!

And girl, if this isnt a sign to do DCF, I dont know what is. Our sign was when NSC LOST our K1 petition. Thats when we switched to DCF and I dont look back on it for a second. Im GLAD it got lost. This way is just SO much better.

:) Happy days!

Well that solves your problem about canceling the petition!

Why on earth would you resubmit it in the US (and you would NOT send it directly to California if you did)? Now you have all your forms already filled in and can jump a flight to Oz!

No kidding, DCF is the way to go! (Talk about a 2x4 upside the head, I don't think this is optional at this point.) hehe You know, at this point, I'm so gleeful that I was half asleep when writing the check I don't really care if I get to go to the interview with my husband or not! :) I would prefer to do it all in one day so we could fly back together, but I'm just so excited that it might be 3 months rather than 10 I can hardly stand it!! My eyes are peeled for cheap flights! Especially if I'm just aiming to hand it in on a Thursday before his interview . . . then it doesn't matter when I go!

Lots of exclamation marks here. Thank you all so much for helping us to discover this option! It has made such a difference in my spirit. WWWWWWWWWEEEEEEEEEEEEEEEEEEEEE!!!!!!!!!!!!!!

Hmmm, now I am totally second guessing myself here, maybe we need to drive over to Syd a day early just to make sure the I-130 and I-864 gets accepted. hmmmm hmmm hmmmm. I will email once more and hope we don't have to because that means another nights family accomodation in good ol expensive Sydney!

And thanks mate, it's nice to have a little silver lining on top of all the grey clouds hanging over our heads. My husband is so positive about things, but I guess me being the emotional and hormonally charged female I am stressing things more. This will be my last pregnancy and I had kinda wanted to enjoy it, since my last 2 were nightmares. My ex will not think of her first, he is a selfish #### who thankfully should be in jail by the end of the year. Isn't it funny how he has NEVER paid child support in 7 years but he can afford a lawyer? hmmmmmmm!!! It's times like these I hate Australian laws which give sperm rights :(

I wouldn't worry too strongly about it. If you haven't been told that you can't do it in one day, then I believe you can! After all, you weren't told you couldn't, so go for it! If they start to tell you otherwise on that day, just argue and state your case. You were never told you couldn't file in one day, and historically that has been allowable. Just go for it and be strong. You can do it.

It's understandable that you're stressing more about your daughter's case. You probably know your ex a little better than your husband (no matter how wonderful your husband is) and so chances are you have more mental fodder for "reasons to be stressed." Your husband has to wait for you to provide them, I'm sure your head provides those all too easily. The trick is to try and ignore them from time to time. You won't always, but sometimes it'll work. And you have plenty of time to enjoy the pregnancy yet. No worries. Just take one day at a time. Peace to your heart and strength to your spirit, mate!
