Okay so heres the update to my fiance's petition.

He recieved a mail from the embassy containing his passport and a letter saying they cannt issue him an immigrant visa because he will most likely become a public charge. It says he's eligble to apply for a waiver! Im losing my mind! I dont know what to do anymore! Im lost now.can someone help me ASAP plssssss!!!!!! I really need to know what to do next!

I'm so sorry to hear this bad news.

I hope you will ask the Embassy as soon as possible to have the Immigrant Visa Unit Section Chief review your case. Also, if I were in your shoes, I would request another interview, and I would make sure you attended that interview. It would give you the opportunity to make a better financial case.

How would i request the immigrant visa unit section to review the case? I been contacting them over and over again but for some reason its not directly at the embassy. Im so upset.i thought everything was gonna work out okay. It seemed they accepted the co sponsors because they took the papers. And the reason why i havent been working for the past year is because my dads on dialysis and im the one taking him everytime.to his appointments, everything. But this past two weeks my cousin was able to get me a job as a homecare provider for an elderly lady. Just so that if my fiance was given the chance to come here, then i would hve some source of income.The grand daughter is the one that handles everything here. Includin my pay and hours. So how am i gonna show them any tax papers when i just started? Gosh, this is upsetting. :)

Would you be able to advice me on what to do about i just talked about above?

And also if its been denied, would they put that in writing? Wouldnt they tell you that the visa is denied? And stamp your passport? They didnt even say its denied.nor get a "denied" stamp on his passport. They didnt even have any instructions on what i can do about it.

^^^ Just because they took the joint sponsors' papers doesn't mean everything is okay. What forms did your joint sponsors fill out? What was each of their 2011 incomes?

^^^ Did your fiancé receive a form at his interview, or did he receive a letter sometime later? If it's a form, what is the form number? Is it form MNL-IV-22? Exactly what does it say? If it's a letter, exactly what does it say?

If he received form MNL-IV-22, then it's highly likely his visa was not denied. Instead, his visa was refused. If it was refused, then the form will tell you why it was refused. Exactly what does the form/letter say?

My joiint sponsors filled out the I -134

My mom made 37 or 38 thousand last year.and she only has two dependents that she claimed in her tax

My cousin had 49,000 last year. And she had 4 dependants that she claimed.

And in his interview, my fiance was given a letter after his interview stating that he had to submit the form he had forgotten

And now he received a mail with his passport and that letter.

Just saying they cannt issue a immigrant visa

And then it gives choices you can check as reason why they cant do that

And they check the 212(a)(4) " he will most likely become a public charge"

don't know if this had an influence on the Embassy's decision, were you listed as a dependent on your mom's income tax return?

I am curious what's written on the actual I-134s specifically # 8 - 10 to let you know why CO thought you are a public charge. Also, did your mom or cousin in the past also sign a co-sponsor for someone else besides their dependents?

I would request a review of your case by the IV Unit Section Chief. You need to do this before the Embassy sends your petition back to the USCIS.

I'm surprised that a Pinoy petitioner's joint sponsor was apparently not accepted.

Tahoma: yeah im gonna do that.also, im gonna schedule another interview next month, which i will be present.cause im gonna be going back home next month for that.his petition will be expired next month on the 5th.do you think they will schedule an interview around november 2nd or 3rd even if it will expire couple days later

It happens because of question #9 or #10. If you or joint sponsor has sponsored other people in the past, it may affect whether you meet the poverty guidelines. That is usually another factor added to the public charge issue. I know a Filipina nurse who maximize her sponsorships because she sponsored too many. She was able to bring most of her immediately family to the US except her sister. The I-864 goes in much more detail than I-134, but it is pretty much the same thing except I-864 is binding. I am not saying that OP has the same issue, but it is worth considering and to rule out.

Well my cousin, which the primary co sponsor, sponsored her mother way back in 2004. But my mom was sponsoring my fiance also. I told my fiance to not use her anymore but when the CO seen hers, he asked for it too. So i was thinking he was counting my moms too. But i been working as a homecare provider for an elderly lady for the past two weeks.i cant provide them with tax papers.but i can get an employment letter from them.do you think i should get that paper notarized so it will become a legal document? Cause im plannjng on getting him another interview and to gi back to the philippines so i cant physically be there for it. What di you think j should take with me besides the employment letter? Cause its kind of a private job. The grand daughter of the lady i care for is the one that writes out te checks and everything. I dont get pay check stubs, i get personal checks. So whatdo u think i should bring with me?
