Hello,

I am not sure if I post in a right Discussion. I apologize if not.

I just got my Green Card and would like to start process of getting my mom here. She lives completely alone in my home country, her health is declining and obviously she isn't getting any younger. I am super worried and want her to be with me so that I can take care of her.

I researched about this and as far as I understood I cannot start petitioning for her to come and live with us until I become a US Citizen. Is there any way around or something else I can do?

I would be so thankful if someone can point me to the right direction.

18th March 2010- Application is accepted

23rd March 2010- Touched....

30th September 2010- Approved at USCIS Vermont

5th October 2010- Case was received at NVC

7th October 2010- Hard Copy NOA2

28th October 2010- Embassy received our case (US Embassy in Bangkok)

5th November 2010- Got Packet 3 from the Embassy

sorry but no, it's the law, only USC can petition for parents and siblings. LPR can only file for spouses and unmarried children.

you cannot file for her until you become a USC. there is no way around it.

There is no way around it. She can come to visit if she gets a tourist visa but she cannot live in the USA.

What you can do is prepare so you can file as soon as you become a US citizen- the main stumbling block will be that you say she is elderly with declining health- this means she won;t be able to work here and health care is expensive. Look into private health insurance for her now, because it will likely come up at the interview- they will want you to be able to take care of her, not just the 125% poverty level but health insurance on top of that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
