Hi Vj's members !!!

have anyone been approved with a criminal record from 17 yrs ago ?? My fiance have 3 criminal convictions, but the one who worries me is the conviction for possesion of a class b drug (cannabis resin)he got a fine of 50.00 pounds. still we filling the waiver I-601 will this help ??

It's written into the law. this has a summary of the grounds of inadmissibility. Scroll to find the ones that might apply.

Or google the references like (INA 212(a)(2)(A)(i)(II)) or (9 FAM 40.21(b)) for the whole detail about amount of controlled substance, etc. A waiver can only be filed after a denial of visa, so you have to go through the whole process and see what happens at the interview. If denied, then a waiver can be filed. Really important to have an immigration attorney who specializes in waivers review the case and prepare the waiver if needed. It's not a DIY project.

And I meant to say people have been approved but it's very detailed about age, ounces of drugs, etc. so your court records provide the detail of the deciding factors. That's why I say look up the actual law and see where your case falls. Another person might have different circumstances.

And if your attorney can't spout those details off from memory, then he's not a good lawyer. You are paying for his expert knowledge of immigration law.
