I-94 Original or Copy? Need help with AOS!!

Dear VJ friends please guide us as we complete our AOS package and my now-husband, who entered the US as my fiance (K1 visa) is ready to apply for Adjustment! I read many of the posts here but still have a few questions and I hope you all can help.

First - DO I send a copy of my Husband's I-94 or the original???

Second- I am a bit confused about the "vaccination supplement" that is required to be sent with the i-485 form. How do I go about obtaining that?

Third - Correct me if I am wrong, but the only evidence I send right now is a copy of our marriage certificate.

And Lastly- I am totally confused about how to go about applying for my Husband's Social Security card. Do I wait until we get his EAD card in the mail so his social wont say "not authorized for employment" because he does plan to work as soon as he gets his EAD. Or do I apply for it immediately?

Please Help!

you can apply for SS immediately. the text just means you need to show your EAD when you are asked for your papers.

think the instructions say send a copy of the I-94.

I don't think the OP was stating anything was lost.

If you file for AOS after 1 year from the medical, then you need to do it again. If his vaccination portion was marked incomplete, then he needs to only fulfill the vaccination requirement.

Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy).

If the medical is within one year AND the vaccination requirement was fulfilled at the time the medical was done, then nothing needs to be done, it will already be in the sealed packet you he handed over at his POE.

Yes, only send in a photocopy of the I-94

Yes you need to send a copy of your marriage certificate. If you have other evidence, then send it in. USCIS understand that K1 couples who adjusting status have just been married. This is one of the reasons for the 2 year conditional green card.

They do not need another full medical, even if they did lose the DS-3025. USCIS has a copy anyway and some consulates, like Juarez, do not even give vaccinations for a K-1 and hand you a blank, useless DS-3025. That does not mean you need a new medical. It just means you have to see a civil surgeon for any vaccinations you are missing and get page 1 and the vaccinations page filled out on the I-693. If you had the K-1 medical within a year of filing the I-485, then another medical is not required.

I just wanted to add to the other advice you received and let you know that the SS card will not come marked that he is not authorized for employment. A K-1 marks off on the SSN application that they are a legal alien allowed to work. The SS card will state it is not valid for work without DHS authorization. That authorization is the EAD. He can apply for the SSN now, so long as he has more than 2 weeks before his I-94 expires. If it is too late to use the I-94, then he will need to wait for his EAD.

thank you guys for correcting my answers.

and sorry for not providing full ones, PrupleBlue.

my vaccination sheet was complete except it didn't have a mark if it is complete or not.

and that's why I had to go and get the civil surgeon fill out the 1st page of i-693.

I spent almost 2 hours explaining that I don't need a full medical before they finally stopped giving me one.

so, as an advice, if you don't need one, try to find a civil surgeon that understands it. for me the difference was huge as the first page filling cost was only around 30 dollars compared to hundreds on the full medical.

They want all the money that can be had for your visit, hopefully you can find a honest one. Ours did a TB test, redid the blood work as it was older than 30 and viewed the x-rays, the exam portion was covered on our insurance, (I had put her on after we were married). You will pay cash for the CS paperwork. Believe it or not got it all done and mailed inside the 90 (our interviewing IO stated it was important to do it that way). Others here say no big deal, if you file for your AOS after the 90.

You always send in copies and never the original unless specifically asked for an original. Read the instructions and look for the heading COPIES and it will explain what they want. Our IO took my wife's I-94 at the interview. If you do have an interview for AOS they typically will take the I-94, hard to do if you send in the original. You will need the I-94 to apply for the SSC along with you passport, K-1 isa and another form of ID or age--they may not ask for the second form of ID but it is listed and it is better to have it and not need it than to have to leave because you do not have it.

Thank you all for your advise. So we will go ahead and apply for SSN and send a copy of the I-94. I was confused because in the instructions is said copy of marriage certificate, copy of birth certificate and I-94. So since they didn't write "copy" before I-94 I was a bit confused. As didopage said - it does get overwhelming :/ but I think we r set now. Thanks again guys.
