My husband (petitioner) just got a pay raise and now finally meets the 125% poverty guidelines requirements.

For how long does he need this pay so we can start filing?

Doe he need an x amount of months at this pay rate in order for him to be able to sponsor me?

(x amount of paystubs?)

Sorry about my english, hope my question is understood.

You can submit it now however I'd wait until the probationary period* is over, if there is any.

USCIS may look into past income however the current(and ongoing) income counts because that will be the one supporting you both. They may look into the past income to see how reliable this new income is - the overall picture. You'll need to submit paystubs (and an employment letter) as proof of income along with the most recent tax return. Id' say when the job is secure, go ahead and submit AOS.

*with thanks to my husband for that term, I used probably 30 words before asking my husband. Your English is fine!

There is no hard and set rule. I would have a cosponsor lined up just in case. There have been cases here where USCIS has accepted it (as current income is all that matters) and cases where USCIS has said it wasn't enough because they wanted to see 125% for the calendar year - ie January through December of 2012.

Thanks for your replies.

He has had the same job since April 2011.

He just got a pay raise, and his pay now is a little above the 125% poverty guidelines for our household size.

It is a permanent/reliable job.

I'd imagine USCIS noticing he has been there since April 2011, so they'd most likely realize it is not a temporary job.
