I just got approved for the I-130 yesterday! Finally! USCIS has had our paperwork since December 19, 2011!! Now I understand our file is sent to the NVC. I am just needing some direction to what is next. I have been living in Western Australia with my husband while we have been waiting on the I-130 and further processing. I had to leave Western Australia to fly back to America for my interview in Colorado yesterday. What a process this has been... Guess I am just wondering is there anything I can do NOW or do I wait to be contacted by NVC?? Also do I need to stay in the USA or can I return to Australia? Are we allowed to continue this from Australia? Would it be faster if I stay in the USA a bit longer and get the process started? My husband and I have been married just over a year so I know he will be applying for the CR-1. Can someone PLEASE give me some guidance and direction for the process with NVC. And please let me know what I can or should be doing now... filling out certain forms, etc. Thanks!!

thanks for that. do you know much about direct consular filing?? is that just for the i-130?? which i just got approved for yesterday... but i read on one website that australia does allow US citizens to do direct consular filings? then another site doesn't have australia listed. im confused!

Well i dont know about the direct consular filing, maybe you post this question on your country portal for better answers

im just feeling a bit sick...im going to be so upset if i find out i could have applied for the i-130 in australia rather than sending all the info for the i-130 to america from australia! its a lot of wasted time if we could have done the DCF in australia for the visa. we have gone through so much drama... it took us forever to hear from USCIS about the petition...from Dec 19 2011 and then got scheduled last month for an interview, which I had yesterday. the petition was accepted but i had to fly from australia to america for the interview. sorry im venting my frustration!

DCF is only in play for filing the I-130 and it is not available in Australia.

ok thanks for that. do you know much about the i-130 being auto expedited if the US citizen lives with the spouse overseas? apparently USCIS will automatically do an auto expedite??

Other VJ members have reported that petitions are automatically handled expeditiously by USCIS in cases where the petitioner lives overseas. However, if you call USCIS and ask about the "auto expedite" queue, they will deny such a queue exists.

Other VJ members have reported that petitions are automatically handled expeditiously by USCIS in cases where the petitioner lives overseas. However, if you call USCIS and ask about the "auto expedite" queue, they will deny such a queue exists.

Yes they will deny it. Also a few lawyers that I talked to have denied it as well. But why would VJ members lie about what they have done through?? I have been living in Australia with my husband and make it known to USCIS when I sent the I-130. We waited 8 months before we heard anything. I had to fly to America for the i-130 interview! AHHH It is approved now, but I am beyond irritated and soooo mad if they messed up our process. It's costing us thousands of dollars extra. Sorry for my venting! Just irritated. Did you have your I-130 processed quicker?

wow, i dont like the govt. uscis lied to me and said i had to give a US address. so i gave both US and Australian addresses. 8- 9 months of waiting and thousands of dollars spent because of having to fly back to america for an i-130 interview that probably wasnt necessary. i got the approval but i am not happy with how all of this has happened.
