I got INA code 212(a)(5)(a) in my interview now we are waiting for the letter that come form either NVC or USCIS God knows when.Now the problem is that my husband says what attorney do we also can do.But i insist to hire an attorney in case if we dont hire any attorney what possibly will happen?plz guide me this will help us to reach on any decision.

What are the red flags in your relationship--

different religions

differet ages?

Who is older?

Any kids?

How many visits together?

Married on first visit?

How much time has been spent together total?

You will get more answers if you provide more information

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

its not 221 its 212 (a)(5)(a) it mean non petionable relationship.I am really frustrated now as i try to call embassy they connect me to immigration department there they play tape and then the call end.they denied me because my husband only visit me on the time of our marriage then due to some reason he cant visit me again but when i got this stupid INA code he come to visit me last month .

They ask me do you have your wedding night i said no and how much time has been spent together total.Yes that black lady told me that my file send back to USCIS

Ok, so they think that you didn't consummate the marriage - that's why you have 212 non-petitionable relationship.So the first time he came, you got married and he just left the next day? How long was he there and where did you two stay or he stayed in a place other than yours?

he stayed at my place we stay together for about one month this time.Yes he came and left and after three days of our nikkah. We spent 3 days full days together but that time not nights but this time yes nights also.

Send another I-130 petition and make sure you cover the part about consummation of marriage. Up to you and your husband if you want a lawyer to take a look at the new submission before it is sent to make sure nothing is missing and that you're covering all bases.
