VISA DENIED...NEW LIGHT

Timeline

I just had the chance to speak more in detail with Papa and he was DENIED based on two things. Not enough proof that we are in a bonafide relationship and he tested positive for marijuana. There is a one year ban placed on him. This isnt a lifetime and we will make it work. For those who are judgmental.. I will say this...I believe in CHANGES AND CHANCES. I know that he had stopped smoking. But I guess the time wasnt long enough. I dont want to here about US tax paying citizens either. I am a tax paying citizen, I am a homeowner and a business owner. So I am very familiar. I am looking for help from those who can help or point me the right direction. Please...I am already in pain....

OK, there is nothing you can do at this point!! Just Book, Pack and Go visit him. There is nothing you or an attorney can do at this point. Go there, marry him and then re file after the one year ban has been lifted. Do not waste $$ on hiring an attorney. My friend recently went through this same thing and her husband is now here with her.

I am so sorry that this has happened to you guys. I am so sick of the marijuana laws worldwide. So many innocent people here in the US and all around the world looked at for this and it is FREAKIN RIDICULOUS!!! :wacko: :wacko: :wacko: :wacko: :wacko: :wacko:

5/10/2012- I-130 has been received & Signed for at the Chicago lockbox at 10:23 am

05/14/2012- Received NOA1 via Text Message

05/17/2012- Received NOA1 via Snail Mail(Postmarked 5/15/2012)

07/27/2012- 9:36 am Received NOA2 via text message (thought it was a dream)

07/30/2012- Started calling the NVC to see if case has been received

08/02/2012 -Called NVC- Rep told me that NVC Received Package 07/30/2012 (Still no case# assigned)

08/16/2012 -Called NVC- Information has been entered and received my case number (Yahooo)

08/24/2012- AOS Bill invoiced and paid

08/30/2012- Emailed the DS-3023

09/05/2012- Sent AOS (Affidavit of support) packet via Fed Ex (overnight)

09/06/2012- AOS Packet received

09/11/2012- Received email notification that the DS-3023 (Choice of Agent) has been accepted

09/13/2012- Received IV Bill

09/13/2012- Paid IV Bill

09/17/2012- IV marked as paid

09/17/2012- Sent IV Package (DS-230) via Fed Ex

09/18/2012- IV Package Received

09/18/2012- AOS Packet Accepted

09/25/2012- Called NVC and found out I have an RFE

09/26/2012- Received RFE via EMAIL

10/01/2012- Sent original divorce documentation (RFE) via Fed Ex overnight

10/15/2012- CASE COMPLETE (Yahoooooooooooo)

10/23/2012- Case complete email received..

11/02/2012- Called DOS and received interview date

11/05/2012- Received email with check list and appointment date

11/20/2012- Medical Completed

12/03/2012- Interview Scheduled

12/24/2012- Entered the USA and got to MN at 12:08 am on 12/25/2012 Merry X-Mas to us

If he really loves you and wants to live together here in the US, he will commit to never ever using drugs. Drink heavily if he needs (except just prior to the medical and interview!!) but do not do any drugs from now on. Period.

And you two will GENERATE all sorts of other evidences and not use money payment receipts as a basis of a relationship; it does nothing of the sort only that money is being sent....in some Embassies this can be seen as buying a fiance.

Aww, so sorry to hear that. Best thing to do is 1) focus on how you improve/add to your evidence of bonafide relationship, of which there are plenty of resources on this and other sites to tell you what constitutes evidence, and 2) he stops smoking. Period. If he really wants to be with you then he'll make the sacrifice. It's worth noting though that the tests rarely come back positive after the 45 day mark so it's a good chance he isn't being truthful if he says he's been clean way longer.

Forgive my ignorance, and I'm being quite serious, is smoking marijuana illegal in Jamaica?

What I'm getting at is I don't understand how it's possible to prohibit someone from immigrating for doing something that's illegal (unless someone is a medical marijuana patient in some states) in the US, but is legal in the immigrant's country.

Just my grrrrrrrr.

(i'm not an immigration expert or anything. but in your case...dear you guys really need an immigration lawyer to back u up...not even marrying him is the solution.)

We've already waited longer than a year so one more wont hurt us. I love him and I have no doubts about his love for me... I trust GOD and HIS infinite wisdom...so I will wait!!! Thank you for the encouragement.

Beat you to that one..lol. I am booked, packed and will be with him on Thursday. How will getting married help? I know we have to wait for the year ban to be up but can we file before the ban is up?

Considering that you knew before hand that recently smoking 'weed' carries a one year ban then I don't think you should be disappointed. Did your fiance admit to using or did the doc find marijuana in his system?

You being denied as well because of a lack of a bonafide relationship between you and your fiance should be an eye opener. Not saying that there isn't a genuine relationship between you both but this is a good opportunity to look at your relationship under a microscope. Maybe have an 'outsider' (someone who is objective and you trust) look at your cell messages and or IMs and tell you their impression of your relationship. The fakeness of your relationship may have come across to the CO due to how your fiance answered his questions eg: too confident/rehearsed, not confident enough, hesitation, nervousness, not knowing basic must know info, vague answers, answering 1 question different times with different answers, story not adding up. Your fiance's denial may also be due to the relationship comming off as a 1 way relationship eg: too many trips in one year to JA by you, too many Western Union receipts (for such a short relationship), the amount sent via Western Union, the converstion in the chat evidence (you're obviously more into it than him/he's professing love very soon after knowing you) etc. Take this one year a chance to see if your relationship is true. Don't rush into anything.

I wont take this as a negative...He admitted to using as Ive said before. And I believe that everything happens for a reason. I made the trips because I love him and didnt want to be apart from him. I just reviewed phone calls from August 15 to the present and he has called me 109 times...hardly sounds one way. He is limited as to what he can do. But I'm not asking you to understand. All I know is that I love him and I believe in his love for me...So we will take this year to grow together...whatever GOD'S will...then let it be done.

I remember you asked about smoking 'weed' a few weeks ago and you were told that if it is detected in his system from the medical he would receive the one year ban.

Although you kinda expected it you will still feel the dissapointment because you care very much for each other.

Since you can visit him often that will have to do for now until you can start the journey again. Good luck for the future you are in my prayers.

It is illegal...very common..but illegal. Still we will just take this as an opportunity to grow.

Well, you don't have to get married, it will just make the next round a bit easier. Also, if you refile the CR1, he will be eligible for more upon his arrival. Glad you are so positive about this, it makes things better. Again sorry for this kind of outcome..
