My husband and I have recently gotten married. He came in on a K-1 visa and we are now in the process of filling out the forms. I am the US citizen and obviously now since we have gotten married my last name will change. I haven't gotten around to changing it yet but will be very soon. Should I use my new last name on the forms since I will be changing it very shortly?

Also, We will be moving but I haven't changed my residence yet. Should I use my address now, or should I use the address I will be moving to very shortly? I will be changing my residency very soon.

Any help would be wonderful.

Use your new name. When will you move? if it's a week, I would wait to file AOS until after. If it's 6 months, then I would just change the address with USCIS when I move.

It all depends on how soon you are going to get around to changing it (and that applies to both). Cause soon after you send in your AOS application, USCIS will send you mail letting you know that they have received your application and if you haven't done so yet they'll be also sending your biometrics appt. If you're not 100% sure as to when exactly you're going to move i'd suggest that you use your current address and when the time comes you submit a change of address. That would be the safest way to do it.

Day38....09/13/12- Received text notification for interview. Scheduled date 10/18/10

Day40....09/15/12- Received hard copy for interview. Scheduled 10/18/12 @ 12:45 Holtsville NY

Day61....10/06/12- Received text notification about EAD card production

Day66....10/11/12- Received 2nd and 3rd text notification about EAD card in production

Day67....10/12/12- Received notification card was picked up by USPS

Day70....10/15/12- Received EAD card in the mail. I'm loving it

Day72....10/17/12- Went to SS Office to apply for card

Day77....10/22/12- Received approval letters for I-130 and I-485. Got SS card

When you file for SSN file in your maiden name because immigration wont have any records of your new name so it wont approve.

thats what happened to me now i after i AOS i can file for a SSN in my married name, which has delayed me .

After you get your SSN and you get your green card u can go back to the office and change it to your married name.

uhm. what you mean immigration won't have any records of your new name?

if you send your marriage certificate, it is a record of a new name.

when did this happen to you? right at the start before your paperwork got approved?

I used my new name when I filed for AOS. I never had issues with it, I got my green card w/ my new name on it, and when we applied for SSN and tried to transfer my husband family name to me, the office clerk said that I already have my new name and seems like it has been updated by immigration when I filed for AOS w/ the new name, and my new family name will appear on my social security card. So yes, you can use your new family name.

But what about the US citizen changing the last name. My husband and I are ready to send our AOS application. He came on a K-1 as well. In the forms, I am using my maiden name not my married name which will only have a hyphen and my husband's last name because I have not change my name on my SSN card yet.

You can just go ahead and use the name you will be legally going by from now on. You can then change your name with SS and all your accounts, ID and such. You do not have to have all that done before listing your married name on the AOS paperwork.

Use the name you'll be using in the future. If that's your married name, then use that on the application. The forms usually asks for any other names used. It will be matched with your maiden name because you'll send proof of being a USC, and because you send your cert. marriage cert. as proof of that name change. Besides that, a copy of NOA2 will also demonstrate you're the same person(that copy is supporting your husband's eligibility to adjust status).

Regarding adress, wait until you move so you'll receive all mail at your new address.
