Is it time for a lawyer?

So, I filed for I-130 back in December 2011, I-130 was received by USCIS on January 12th, 2012 after that it has been in the same status "Initial Review" currently. I called USCIS and the rep said that he would send out an request which back in April 2012 and was told to wait 45 days for response. Its september 10, 2012 now as of this writing and just a week ago, I called back and I was told to email (forgot the email at time of writing) for a followup. It seems that this is taking wayyy tooo long and am wondering if I should get a lawyer now. Its something i'd have hard time affording but I feel as though waiting will just delay it longer.

Anyone know any good family lawyers in Madison, Wisconsin? Any advice would be much appreciated.

A lawyer can't speed things up. Try calling USCIS and insist on being escalated to an immigration officer. Ask where on the processing floor your file is, and can he/she please send an e-mail to the floor to ask that the file be moved along to the next location.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Okay, I will do that. I went ahead and just emailed csc-ncsc-followup@dhs.gov which was the one provided to me by the rep.

do not get a lawyer save your money he cant do any thing,you can get your comgressman or state senator,is the 1-130 for your spouse or family member,for family member it takes long time like f-1 fb2 fb4 takes many many years, see what they send you back the E,MAIL response,

This is highly unusual case. We filed around the same time and got our visa interview done last week at Mumbai Consulate. So yes, you need to take immediate actions to speed things up at USCIS. Call USCIC ASAP and ask to talk to tier-2 officer (they have more insights to your case then regular operators). Ask them to give an update of this status immediately. Also contact your local congressman to help push things at USCIS. Don't just keep waiting for USCIS to repond, because you have already passed normal processing window time frame.

Hi, Stenzin. I agree with the posters in this thread. Since a lawyer cannot speed the process up, you should escalate and send that email they requested.

Def sounds like you fell through a crack somewhere in the process. Noticed you don't have a timeline, but considering you are in CSC where processing is clearly under 3 months, you are well over that.
