Hello,

I just have these 3 questions:

1) When does your K1 VISA start counting down? Do we go by when it was issued or the date that is stamped on the I-94, which is the date of arrival to the United States?

2) What are the fees involved for applying for the "adjustment of status" for the Green Card?

3) When we do file for the Green Card, how much time will they give us to stay in the United States while awaiting the decision?

Timeline

1) The K-1 visa expired the day you used it (entered the US), it is a single-entry visa. What is important is the I-94. It expires 90 days after your day of arrival with the K-1 visa (day it was stamped).

2) Adjustment of status (AOS) from a K-1 visa is $1,070. I advise you to also file for I-131 (AP=Advance parole=temporary travel document), and I-765 (EAD=temporary work authorization) as it is free when you file for them in the same time as the AOS.

3) You need to get married in the 90 days after your arrival with the K-1 visa. Then, you should file for AOS as soon as you can after you are married. You are authorized to stay in the US while your AOS is being processed. You will receive a Notice of Action after sending your AOS paperwork, which is your proof document that you are waiting for your status to be adjusted. AOS can take a few months as it can take a year, that is why it is advised to file for EAD and AP at the same time. EAD/AP has a different timeline than AOS and is generally approved in 2-3 months.

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

Timeline

I just wanted to add to the answer for #3. You are to stay in the US after entering on a K-1. You cannot leave the US without having AP or your green card. If you leave before having either of those things, you will abandon your AOS process and will need to file for a spousal visa in order to get the foreign spouse back in the US.
