Did he request an accommodation? That is about wheelchair access, patience with problems speaking or memory problems etc. It doesn't mean they can't try to root out fraud.

How old are your children? You did meet and marry quickly - within 2 months?

Some scams involve preying on people who are desperate, like someone on permanent disability. It is your job to prove why you chose him above all people.

His disability is depression?

The officer had his paperwork in her hands when she asked him those demeaning questions. His Disability is mental depression for which he has been going to counseling. I was aware of his disability before we were married and my husband is not desperate. He is from a wonderful family who welcomed me into their lives. They even helped me get my son here with us. He is very educated and his only problem is dealing with the depression. We do everything together including attending his meetings and therapy sessions. We are quite a stable couple and our friends and family were wonderful in supplying us with over 30 affidavits of marriage. We walked into the interview thinking our marriage in itself would be enough but we were mistake.

That is awful, sorry that happened to you.

It doesn't sound like a standard interview at all. It seems to me that the officer had a very strong fraud indicator in the materials that you submitted (photos) or the circumstances.

Not saying that your relationship is fraud but even I got a little confused reading your post about the situation. They can only make judgement about your relationship based on the evidences you submitted, if there was a doubt and confusion about who is who in the pictures. The friend was mistaken for the wife or the wife was mistaken for the friend, things like that shouldn't happen.

So maybe you have to go over your evidences of relationship and see if you can make it more clearer for a total stranger to form a good picture of your relationship.

Above all, you both must remain emotionally strong and be firm and convincing with your answers.

Some CO's seem to think they can detect fraud by verbably attacking people. We are mixed races I am white and he is black , we are both degreed engineers and he was asked at his interview if his father died when he found out he was marrying a white woman. So much for courtsy. This shall all pass and you will go on.

This will not be over quickly. You will not enjoy this.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I am sending my good thoughts and prayers. Don-t let any negative situations, even when it looks harder than ever, take your warrior spirit away. I am truly sorry for this treatment you both got there. As other visajourneys have said, it can be difficult sometimes but this is another level. When I married my husband he had zero money, I was the one working, but we opened our mutual bank account, we showed pictures of what we could, emails, letters, even the books we gave each other. I heard so many stories of how some couples would get different interviewers and harder situations. I was afraid we would face a interview like these but it was better than I expected. Another friend of mine had a problem with her visa and she only found out about it at the interview. The officer was yelling at her and her husband could not even speak. They were very intimidated. The officer treated her as she was trying to trick or make a fraud. But it wasn't her fault.

I admire your husband, he was supporting you all the time. :)

The 2 month Marriage is the obvious RED flag here.. This looks fraudulant to them I am sure.. They try to rattle you and root out any thing not to their liking.. It is what they are paid to do.. I am sorry that you had to deal with this, but you really need to have your "A-Game" when you are at the interview... Not answering or telling her to slowdown or stop so you can answer her questions, really supports her concerns here... Speak to the housing concerns as you did here.. You are now behind the 8 ball for sure.. Score 1 for her on getting you rattled and out of your comfort zone... Lawyer up for sure and get through this... Good Luck!!!

The officer treated her as she was trying to trick or make a fraud. But it wasn't her fault.

That is the whole point. The interview isn't supposed to coddle potential frausters, it is meant to find them.

The officer could have been concerned that you married to avoid deportation or a ban for overstaying your B2 visa. How long was your overstay?

:wow: I have heard before that interviews can really be difficult. This really took it to the worst level. :angry:

Hope your lawyer makes the right moves to get you through this. Sigh:

This is not a "difficult" interview...this is a "cruel" interview. You should have stopped the interview, write down her name, and report her. This is waaay beyond. Even if her own personal perspective she is racist, she cannot and should not be able to openly express it in situation like this. She can sure tell her best friend secretively that she hates blacks, but come on!!! This is BEYOND! I can't believe this!!! I really hope that one day she'll get this payed back at her....when she'll sit back and in tears think why she deserved whatever she got...I can't believe this...this is not normal!!! I do hope that either they have hidden camera and voice recorders built in, or someone in the neighboring office heard it and do something about it...either way, this have to have a serious consequence, and that woman should be removed from USCIS' interviewee list! Tell your wife to hang on, don't take it at face value! Not everybody is a A-hole like this woman was...most, NORMAL, people have no problem of her origin, or skin color...Tell her, I wish her to recover and shake it off (easier said than accomplished). Wow, this is so bad. My interviewing officer was far from friendly, but he was professional and polite at least...

I did memorize all of my USC husband's family members' name though. It was difficult to remember because some maiden names and middle names are in Chinese and are very long. Regardless, I did memorize them just in case.

My lawyer says this is not a normal interview. This officer has no right to discriminate against anyone. Discrimination is not a tactic used by the USCIS. You should never be judged or discriminated by anyone in public office. This law makes it illegal to discriminate against someone on the basis of race, color, religion, national origin, disability or sex

This is just a summary of the interview. My wife was called a bad mother because her kids were in Trinidad. When I explained that we have her son here living with us, and that we are adjusting his status she went on to say why one son? Why do your parents have to take care of her and her son? The entire interview was demeaning and no one should be treated like this

After discussion with your attorney, if you believe misconduct occured on the part of the interviewer, instructions for reporting it are here.

Although attorneys are rarely reccomended for a straight forward case, one advantage of having an attorney at the interview is that they can stop the interview and request a supervisor review immediately (without terminating the interview). One of the reasons they would do so is for abuse/misconduct or overly aggressive behavior by interviewer. The interviewer has a wide latitude on the tactics they can use, but overall, they are required to maintain a non-adversarial approach.
