I'm esta holder. And I got married with us citizen. My departure date is 28 sep 2012.

So 18 days left..

I filled out the forms completely. But I couldn't make a medical check up. I called the hospital to make an appointment but they said I can make an appointment in October.

My question is:

1. What paper works should I turn in with forms(485 130 131 864 etc.)?

2. If I can get the medical check in time, is it gunna be illegal to stay in the state.

3. Can I turn in the forms first and turn in the medical check later like October ?

4. What should I do.....

Call another Civil Surgeon who has an earlier appointment.

THe other questions (like forms) were answered in your other threads.

well, if you apply for esta before you entered the States, I'm assuming you enter the States without any visas, right?

So you entered the States with Visa waver. Thats means, you supposed to leave in 3 months regardless. And its not really good idea to stay there with visa waiver just because you married with US citizen. Get married with US citizen while you are staying there with Visa waver is totally fine but if you are planning to live there or stay there over 3 months is illegal i think.( cause the propose of visa waiver is not for applying green cared over there) Thats why everyone here is applying K-1, K-3 or CR-1 to live in the States legally.

And even if you get medical check on time and passed the medical test, it doesn't mean USCIS approve your petition. So you are going to take a huge adventure here.

If I were you, I would leave the States on time and apply visa and I would make process everything legally.

I'm sorry if I was wrong but thats all I know.

Actually, this section is for people adjusting from NON FAMILY BASED VISAS. Or the VWP. Not K-1 or CR-1 or anything of the sort.

And it's legal to adjust from VWP.

OP, you need to find a civil surgeon, as Harpa said. If you send your stuff in without the I-693, you will get an RFE.

No, only a civil surgeon can conduct the examination and complete the I-693.
