Hi Vj Member,

Help on my situation,11-12 years ago my brother wanted to process U.S student visa for me at Lagos,Nigeria Embassy and he contacted a travel agent that prepared the documents then on my name but unfortunately i was refused the visa due to i cant demostrate or whatenver reason i cant remember i was younger then i was at age 21-22 years and the i cant even remeber the documents he used for me and who was claimed as my dad or sponsor for my admission in the U.S but now i am 32 years and met my fiance and she filled CR-1 marriage visa for me and all has been approved and interview scheduled next month at Lagos Embassy,Nigeria but now am scared and my name on my previous apprlication 11-12 years ago was the same as my name now but only the middle name is different.but am i want to seek help from poeple that has knowledge about this,i want to ask would they know if i have ever applied for U.S visa 11-12 years ago? i thought they delete all information after 10 years? would they ask if i have ever applied for American Visa and been denied what would i tell them? because i cant remember any information about it and i didnt so any finger print,should i tell them i have never applied because i didnt do finger print or they can detect? cant this affect my CR-1 Immigrant visa ? EVERYTHING IS TOO CLOSE TO MY INTERVIEW...PLEASE ANYONE SHOULD HELP IN WHAT I CAN DO? I LOVE MY WIFE AND CANT WAIT TO BE WITH HER!

Hello Yomi, does she know about this previous application?

Are you using the same passport, I think not (ECOWAS) but just want to ask. They placed a notation on my passport on original tourist visa application. The CO and I discussed the notation when I went back for a student visa a few months later. This was eons ago so process might have changed.

Good luck. One thing, don't sound/appear desperate at your interview. The option for her to move to Nigeria so you too can be together should still be on the table.

First, is she your fiancee or your wife? If she's your fiancee, meaning you are NOT married, your visa will be denied given she filed a CR-1 marriage visa. You must be alraedy married to receive that visa. Second, yes, they will find out about your previous visa petition and the misrepresentation on the paperwork you filed for this visa. Expect a lengthy Administrative Processing or a denial.

Don't ever do anything you're not willing to explain the paramedics.

They have records to prove you were refused a visa before and apparently you failed to reveal this on your paperwork. Previous visa denials alone are not cause for a denial. However, misrepresentation(s) are grounds for denial. You lied in your previous visa application- which I'm sure triggered the denial- and now you lied on this one.

Did she marry you in her first visit? It's almost a certainty you will be put on AP given Lagos, Nigeria is the country with the highest immigration fraud in the world. The scrutiny is detailed and meticulous. Virtually all males coming from MENA/ African countries go through AP; some cases it lasts a week and in extreme cases it lasts years.

There's always the option of your wife moving to Nigeria to be with you.

You cannot meet with the consular office to explain before the interview. That's what the interview is for. You explain things at the interview after the US completes it checks based on the paperwork you submitted as the truth.

The US has a record of your past application. The reason the US requests you disclose information that it may already know is to test your truthfulness. It's easy to catch liars if you ask them something you know and they give you the wrong information.

You are required to disclose your denied visa in your forms. Failure to disclose your denied entry will hurt your chances of getting a spousal visa as you have noted.

There is very little to do now except go to your interview. You have to accept your fate. It may not be a problem. It could be a problem. You will get your opportunity to explain why you left off the denied visa in your new application at the interview.

Hi Yomi, it's important for you to put your mind at rest, at least now that your interview is around the corner. If you get asked about your past visa application, answer truthfully and leave the rest to God. From all indication, nobody can tell what was in your precious application, even yourself. So the best thing is to be prepared to answer truthfully and hope for the best result. If you are caught covering up on material facts, or trying to lie, it will be more devastating. You don't wanna lie ok.

Thanks alot....i never wanted to lie,i am a truthful person and my word is my life...i would have disclose this in d2-230 form but they didnt ask if i have been refused a U.S visa if they asked i would have disclose it...and i dont think they ask during our 130 petition with the USCIS...does anyone knows what forms they will ask if i have ever been refused U.S visa? so i can say the truth?

Yomi, when you are interviewed you are sworn to tell the truth. Same as when you interviewed before you were sworn to tell the truth about the information you submitted.. Truths don't need any embellishments. Be honest if asked. Chances are you are driving yourself crazy about something that may not come up. If it does come up, acknowledge that you had help filling out the forms and to your knowledge everything you submitted was factual. Remain calm, confident and most importantly REMAIN CONSISTENT!

My husband and I applied for a tourist visa and although we discussed this when we were preparing for our interview; the CO never brought it up.

Thanks alot Olomi..Truthfully i had help filling the forms because i was still young and i will say the truth but to my knowledge every information was truth but is there any place on USCIS or NVC forms that were asked if i have ever been refused a visa? am asking because i didnt see any place on the forms where they asked that including DS 230 form i filled they only asked if i ever been refused an enrty into the United States at port of entry and i said No because i have never been to the U.S port of entry...they didnt ask if i ever been refused a U.S visa? or maybe i didnt notice can anyone tell me if they have asked on any forms?....am only prepraring to say the truth during the interview if asked????????????????

They never ask in any forms whether you have been denied a visa. So you never lied in the form okay. I know you need to have a 100% confident during your interview, hence, trying to clear all grey areas before then. However, you have to make up your mind right now that everything is fine. Tell yourself that you're well prepared and regain a full self-confidence going into your interview. Re-oriente your mind and believe you're fine. Be ready to answer only questions asked and don't bring up issues not asked. I've seen a guy out of forbia, when ahead to disclose an info not requested, because he has been nursing the fear and his thought process was centred on that particular issue. He never got to spend 5 mins before his interview was over. The next was his petition being returned for review and possible revocation. The bottomline is have a liberal mind going into this your interview and relax ok. Let us know how you fared after. All the best!
