Hello Guys , I'm the joint sponsor for my Friend's husband , so I fill I-864 , I have a FIANCE who's living with me and willing to fill I-864A ....

In Q 21 : section g :

(OPTIONAL): If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here....

My Question Is : should I count My Fiance as he's a holdsize member ? even it's (optional) ? and they didn't mention (Fiance) exactly ?

In this circumstance, your fiance cannot be counted as a household member for the affidavit of support.

Your fiance can be a joint sponsor filing an I-864. He can only combine incomes with his qualifying household members. You do not qualify.

Hi ANH MAP ,Thanks for the Reply , but i Can't Undrestand Exactly what do u Mean By (He can only combine incomes with his qualifying household members. You do not qualify. )

Please ...can you tell me what the best to do in this Case ?

You cannot add his income to your income to meet the sponsorship requirement. A fiance is not a qualifying household member.

You cannot combine your income with your fiancee. He is not related to you. He cannot be counted as part of your household member for purposes of the I-864.

Fiance is not mentioned for a reason. It's not an option to add him. Only those listed (sibling, parent, etc.) are acceptable household members.

So Guys what you suggest for me to do ?

I Can think of 2 ways :

1: don't Mention Him in the Q:21 , but i wonder if he has the ability to complete and sign the form I-864 ?

2: Make him complete and Sign I-864 as Secound Joint sponsor ?

or if there is any other way I can use it please

Thank you

You don't include him in q21. He is not related to you. For all intent and purposes, he could be your roommate. So, you do not include him in your household count.

You can only count him as a household member after you get marry. Before marriage, he is no more than a roommate for the I-864.

There is only one beneficiary - your friend's husband.- so there can only be one Joint Sponsor. You must meet 125% of the poverty level to be the Joint Sponsor. He cannot have a second Joint Sponsor.

Leave your fiancée out of this, he cannot file Form I-864a as your household member because he is not legally related to you. He can not file an I-864 as a second Joint Sponsor.

If you are the Joint Sponsor, them he cannot be involved because he is not related to you.

If your individual income is not enough to meet the sponsorship requirement then you cannot be a joint sponsor.

If your fiance's individual income is enough to meet the requirement then he can be a joint sponsor.

You will not include the fiance is your household count. The fiance will not include you in their household count.

well , thanks alot for making things Clear .. But the Problem is that My Fiance and I got a joint Tax Returns ? so what to do Now ? am confused about this ..

You can't file a joint tax return with someone you are not married to. That isn't an issue for USCIS to sort out. That's between you, your fiance, and the tax man.
