Good evening everyone,

I have another question and hope you can answer it: When my wife filed for change of status, she got approved several months after her J1 visa expired. We both know that she was authorized to stay in the country until USCIS made a decision. Anyhow, she got approved during the Spring semester and it was too late to sign up for classes. She also had to take placement tests, as her adviser didnt allow her to take those until she her application got approved.

She almost spent 2 months in the US doing nothing after she got approved and until she was allowed to start school (international students usually start in spring or fall, but she started in the summer to maintain her status.

My question: Was her college right to tell her, that she can remain in the States for almost 2 months until she was able to start school? Or was that wrong and it may be an issue at the interview? We never heard anything from homeland secrurity or such and she has been a fulltime student until we filed for AOS.(our biometrics appointment is scheduled the end of September and we hopefully get the interview notice soon).

It shouldn't be a problem since her Sevis wasn't terminated. No worries

When you have filed an AoS application then you enter a new period of authorised stay that lasts until your application is finally adjudicated.
