If marriage was terminated by Annulment Decree, do we need to bring CEMAR with finality papers from the court?

^^^ You are a K-1er, so you need to bring your annulment papers and you need to bring your NSO CRS Form No. 5 - Advisory on Marriages.

You can get your NSO CRS Form No. 5 - Advisory on Marriages from the NSO by applying for a CENOMAR through the NSO. You apply for a CENOMAR and, since you have been married before, the NSO will issue you the CRS Form No. 5 - Advisory on Marriages. That document is unofficially called a CEMAR. So, in short, no matter if someone is single or if they are married, they apply for a CENOMAR. If they are married or have been married, they will receive the CRS Form No. 5 - Advisory on Marriages (CEMAR). If they have never been married, they will be issued the NSO CRS Form No. 4 - (CENOMAR).

Is that as clear as mud?

Also, the consular officer may ask you to submit a Certificate of Marriage from your previous marriage. You can also get those from the NSO.

But when I read through USEM website this is what it says, didn't say anything about CEMAR in addition to Annulment Decree.

6. MARRIAGE RECORDS (if applicable): For Philippine marriages, the copy of the marriage certificate must be printed on National Statistics Office (NSO) security paper. If the marriage ended by divorce, annulment, disappearance or death of the spouse, legal and/or civil documentation must be presented attesting to the termination of the marriage (annulment decree, death certificate issued by NSO and printed on security paper, a foreign divorce decree, or foreign death certificate).

^^^ :thumbs: :thumbs: ...Note to the OP: You get that document by applying for a CENOMAR at the NSO.

You likely will need the CEMAR and the annulment documents for your CFO also. And don't forget St. Lukes...you will need your annulment documents there if you claimed "psychological incapacitation" on your annulment.

I was annulled and got my interview last year at the USEM. Your fiance/e should secure an Annotated Marriage contract from the NSO is a Cemar with an annotation at the side stating that marriage is null and void..together with that your fiance/e should also bring the document he/sh got from the court (i.e the decree, decision, and et.al - this ar all provided to you by the court ones decision is finalized )

Great, thanks everyone! We got the Annotated MC from NSO when he updated his status after it was discharged, docs from the court and civil registry already. I just didn't realize that we still have to get the Adivisory on Marriages as well.

Yes, Psychological Incapacitation was the ground for annulment.

Ok so apply for CENOMAR but I'll get CRS Form 5. Advisory on Marriages right instead of the CRS Form 4 Certificate of No Marriage for invidivuals who were never been married? :blush:

All I brought, showed and submitted with the CO in the USEM are the annotated marriage contract and those court documents..they have not asked me anything more than that. CRS form 5 is th application form to secure for a CEMAR...in your case, since she already have the annotated marriage contract, then she should be good to go. When you apply for a Cemar fro the NSO and as an annulled individual, she will be asked to fill out the CRS form 5, and one submitted and paid what the NSO will issue to her is the Annotated marriage contact. If you need to verify, it might as wel best to ask the NSO office to be sure.

Well we just want to avoid getting 221g and cause possible delay. He'll be at NSO this Wed to try to get another copy of his BC, and MC and my BC as well. Thanks again! :thumbs:

Yeah, male beneficiary is rare here :D and yeah 221g is what everyone wants to avoid, I prepared too for my past interview and gathered necessary documents..they do look at the annotated marriage contract and the ourt document tho..and keep the original file but they sent me back the court documents when I got my visa...but not the annotated marriage contract. good thing I ordered extra BC and Annotated marriage contract and asked my attorney to provide me additional copies of my annulment papers from the court..well, its just me trying to prepare what awaits here in th US and just incase I ill be asked to submit originals (off topic ) Goodluck to both of you!

ang may hawak ng annulment case mo, once its all done lahat yan marreceived mo at magdemand kna din ng MC from NSO with annotation na at hingin mo mga official receipts(as proof)

RE:sa custody ng anak mo, if teenager n yan, avoid mo ng magfile kasi dapat pinagsabay yan ng lawyer mo sa annulment though as pricey as annulment din yan. like i said if teens na anak mo, kausapin mo na lng heart to heart kasi papipiliin yan ng judge, what if hindi ikaw piliin, mahuhurt k both sa heart at sa pocket (just saying, dont think otherwise) at long procedures din yan. You wife will apply for a CENOMAR at NSO (one always applies for CENOMAR), the will issue a CEMAR (CR-5 I believe is the form number) showing she is married.

You are a USC the embassy will want a copy of your divorce decree.
