I have sent my packet and am hoping for our NOA2 around the end of November. I have a concern as to my i134.

My employment is not full time or part time I am Per Diem. I do however get on average 32 work hours each week (full time hours) for the past three years. I make 125% over the poverty level but my hours are not guaranteed. Will this be an issue? Because if I switch to full time I will not make the 125%.

Does anyone know if this is bad?

My work will only state on their letterhead that I am an employee in good standing and that I am Per Diem, they will not disclose my income (but my human resources will provide my last 3 years of pay stubs).

Any ideas or anything here guys and gals.

It should be fine. especially if you have 3 solid years of income on your income tax transcripts. Which isn't necessarily needed for I-134 but will be needed for I-864 when you adjust status. It also depends on the consulate. Some are tougher than others. For us in Brazil, I showed my last years tax returns (she had all 3 years of mine if needed for any reason) and 6 current months of paystubs and letter of employment. We had no problem. But, like I say, if you fill out a little of your profile, specifically the country, you will get answers from people who have dealt with the consulate of your significant other.

Your timeline shows you are probably due NOA2 within next 2 weeks... Maybe you will get it before end of october

Some companies are dreading that they're signing a contract by stating the minimum salary on a letter like that. Since it's not a requirement for a company to make such a letter, it's not a requirement to have such a letter at interview(allthough it of course helps to prove your point).

3 years of working, a steady income.. As long as you have your tax return(s), your paystubs etc. They basically are looking for your fiancee to not become a public charge now and later. By looking at your current income and how steady it is, I betcha it'll be fine with what you have gathered.

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

I didn't send tax returns to my fiance since I don't have them, however I did send my W2 from 2010 and 2011 and 3 paycheck stubs from the last few months, I hope to GOD that is enough.

(is the W2 good enough?)

The W2 shows me making 200+% poverty line. :blink::wacko: but I'm still Per Diem and I hope that wont affect the interview..... I did get my dad to fill out a co-sponcer with his tax returns, but I am having my fiance hold them in her folder and not disclose them unless they say I don't qualify because my work hours are not guaranteed.

Your filed taxes show if you have dependents which they use in figuring your 125%. W2 doesn't really show that. They count you, your fiance, and dependents .... That determines the amount you have to make 125% of.

Not an issue. They do not care if you are full time or part time or per diem. They don't ask. They care that you meet the guidelines. You are not even required to be employed, it is just an easy way to make the qualification.

In your case I would submit most recent year tax return and recent pay stubs showing continuing income. And in a bank letter or bank statements if you want. Employer letters are not required and would probably not be in your best interest, so don't.
