Hi everyone, I need your advice again.. I hope you guys can help me..

My fiance and I are getting married next week and we will file the AOS as soon as possible..

Question:

-Is it necessary to file the paperwork within 90 days of my arrival here in the united states? I arrived Sept. 2 and my I-94 stamped Nov.30

-Do I need to seek a civil surgeon before we file the paperwork? How important is it?

-should I attach the copy of my vaccination along w the paperwork?

Requirements:

> Payment

> I-94 (back and front copy)

> Visa (photocopy)

> 2 pcs. of passport photo

> passport (biographical page)

> NOA2 approval for 129F

> Birth certificate (photocopy)

> Marriage certificate (photocopy)

> I-693 (form from civil surgeon)

> G-325A

> I-864

> I-485

> I-765 (optional)

> I-131 (optional)

> G-1145

These are the requirements I found here in Vj on how to file the AOS..

Is there anything I am missing? Please give me some insights.. We don't want to get RFE for sure..

Many thanks,

Kathy

The 90 days they are referring to is your 90 day requirement to get hitched.

You are absolutely NOT required to file your adjustment of status within 90 days.

if you worried about the 90 days requirements No you don't have too.. the 90 days only required to get married.. after you got married within the 90 days.. You can file the AOS anytime..

Good-luck and best wishes for both of youkicking.gifkicking.gifkicking.gif

The sooner you file your AOS, the sooner you will have your EAD (work permit), AP (advance parole), and green card.

The 90 days goes fast when you are finally in the US... My fiance (wife now) did it within 15 days.

If you look at my timeline you will see when we got married and applied for AOS.

We just did it in court with some a few family members..

Just try not to take too much time before you know it.. you're already at 60 days.

Its all too much work to miss not doing it within 90 days.

One thing to consider when deciding WHEN to apply for AOS... many states will not issue a driving permit or license with an expired I-94. The next document they will accept is a I-797 showing proof of having filed for AOS, or a green card. If you want her to have a D.L., you might want to either get it before the I-94 expires, or speed up the AOS application.

But as mentioned above, a person can remain in an "out-of-status" condition indefinitely (waiting to file AOS), with no hassles from USCIS, but it *might* cause issues with certain states.
