Hi,

I've been married for almost 3 years now on K-1 visa within 90 days of entering the USA, but haven't filled for the AOS yet as we are tight in cash plus my husband was diagnose with serious illness. Is anybody here have any experience in filling late? will they give approval to my AOS? We sent my application last Aug.22 2012 until now we haven't heard from them,am so worried sick about my application.

You can file AOS anytime after marriage.

However, if you are filing late it is recommended after a length of time that you include the I-130 with your application to be considered an application for a relative.

As long as you met the requirement by "getting married within 90 days" , you can file for AOS anytime after. You'll probably get your NOA soon. Good luck and i hope your other half gets well soon. :)

Hello there,I entered USA as K-1 visa and got married before 90 days. I've been married for almost 2 years and took us 1 and half year to file for my AOS because of financial problem.My husband got hurt on his job and took 9mos. to recovered.I just filed my AOS with the I-765 last April 12th,2012 and fortunately my I-765 was approved last July 12,2012 and i haven't heard anything about my AOS. I understand how you feel this times. Let's just hope and pray.
