You are turning in a government document that you knowingly filled out with incorrect information, and then admit to it. This is telling the USCIS that you think it is okay to lie on federal documents, such as the ones you have filled out for them, so they will have reason to doubt everything you have put on your forms, and thus give them reason to deny you.

im sorry sir?! as far as me and my husband's concern we are doing the right thing,if not why he even had an appointment to USCIS? just to let them know about our case?..we are basing of what they telling us to do. like what im trying to say here the hope that they giving us is enough to start doing our papers.if they deny my son or they want us the to do the right thing like correct my son's BC we will do it,but its not gonna harm us on trying...god will guide us..thankyou for all the advice and comment :)

I am trying to help you. You made a reasonable mistake. I am trying to show you the difference between two situations; one is more favorable to you than the other.

Situation 1: You fix birth certificate, then your husband petitions for his stepson. The US Embassy will never know that you provided false information on the first birth certificate. No need to explain anything to the US Embassy. Easy, regular situation because the US Embassy only has the correct birth certificate.

Situation 2: Your plan of submitting a false birth certificate with an explanation where you admit to providing false information the Philippines government. You now have given proof to the US Embassy that you have lied on a legal form provided to your own government. Admitting that you provided false information and explaining it does not undo the fact that you provided false information.

I hope that you can see the difference between the two situations. Look at your situation through the eyes of a critical and suspicious consular officer reviewing your case who is not your friend. Don't think of him as your friend who you can explain things to. He may not care about your explanation. He may not even allow you to explain.

I don't think you understand what you have done/are doing.

It's like you are caught driving a stolen car and tell the officer you'll just return it. You have already broken the law by lying on the birth certificate, I expect from your posts you have already submitted this falsified document to USCIS. It's essentially a FAKE birth certificate and they could assume that you were going to try and falsely claim USC for the child. It doesn't matter what you do to explain away your lie and deceit, you still lied on an official document for stating your husband is the father when he is NOT.

Your son is not your husband son. He isn't eligible to be petitioned for a visa because he's the child of a USC, per the fake birth cert. He's not eligible for USC because he's NOT your husbands son. You are making your lives harder by not fixing this now and doing it the right way.

But by all means follow your own path. I expect a lengthy delay for you fixing this problem, if not all out denial for lying to immigration.

**Edit - I understand your reasoning for doing it. If it didn't involve immigration it might not matter, but it DOES involve immigration and sometimes USCIS aren't nice about people lying to them (doesn't matter that at the interview you're going to explain, you've already lied to them and then , in their opinion, are going to try and "explain away" the lie).

You are wasting your time and money, once you write USCIS a letter explaining anything, you are done . This letter goes in your file with your name, your husbands, your sisters, your brothers, your fathers your mothers, and everyone in your family’s name. Government is in the business to collect information. You have the chance to correct the wrong information, without the U.S. governments involvement, if you think a letter of explanation will help you with faceless autocrats, you are mistaken, they will use this letter of explanation against you.

I understand that you guys have already talked to the USCIS and that they just asked for a letter of explanation. I also understand that your husband is the only father your child knows. What I don't understand is why are you opting not to correct the birth certificate when you actually have a chance to do so. I clearly do not work for the USCIS nor I know anyone from there, but why would they accept a document that has some false information?

If you'd stick with working on that letter of explanation before youd rectify the BC don't you think you'd be losing some time on that? Just saying..

hello everyone! we applied our i130 and request to expedite it and god is so good we got approve and now we are waiting for our noa2 hard copy :D thanks for all the response everyone we really appreciate it i been worried for the whole time but hubby told me we dont have to be worried because we are not hiding anything and he is right me and my son got approve! all he did before we filed he keep on calling the USCIS and US embassy to ask about our case and they were right as long as we are telling the truth they were gonna approve us..just keep on praying and believing to god because nothing is impossible when u trust everything to him..god bless us all!
