I am getting ready to file the AOS for my wife, I was wondering if it is necessary to get the SS# before submitting the AOS packet, or if it can wait... I am away at college and without transportation for a while, and am not sure about some of this process. Also, from what I understand, we need to go see one of the approved civil surgeons if a shot is missing, right? I am unsure of what the DS-3025 is...

It depends on how much longer her I-94 has before it expires. I think if it is within one month then you will have to wait until your EAD is approved. You don't need your SSN to apply for AOS. However if you have longer left on your I-94 then I suggest that you should get to the social security office and apply for her SSN. It will allow her more freedom, such as joining your bank account, maybe insurance and other things. This will all help when you need to have evidence for your AOS interview. I am currently in the situation where I did not get my SSN and as a result I have very little evidence for our bona fide relationship. We live with her parents and have no lease or utility bills in our name and we do not have a joint bank account. The only evidence I have is photos so far. But my EAD was approved last week and I will be going to the Social Security office the day I get it. Then at least I might have some time to do some of the other things and get more evidence. BTW my AOS interview is on the 10th of October

I was told by the social security office that we cannot apply for a SSN because we got married, that she could have applied when she got here on the K-1 visa, but that now we have to wait for the adjustment of status...

I was wondering if someone could verify that for me

(we got married two days after she got here, that's why we didn't apply before...)

I don't believe that is true. Some workers at the SS office get confused if you tell them that you are married. They wrongly believe that your K1 status expires on the day you get married - which it doesn't. You should try going to another office and apply using your maiden name. You can change it later when you get your green card. I hope that helps. Oh, and you need to have more than 14 days left on your I-94. So if you've been here for 76 or more days you have to wait for your EAD.

Oh, and I know some people had issues with the workers not knowing that K-1 visa holders were allowed to get a SSN. You could print this page https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530 showing that you are eligible to apply and take it with you. Scroll down to find K-1 info.

That is not true, You cannot apply for SSN "IF" your k1 visa has expired "NOT" when you got married. We we're 7 days late when we attempt to apply for SSN. The office told us to update with the immigration or have a green card to get SSN.

That's not true as other member as pointed out. Sadly, some officers have no idea of their own rules. We had to give the officer a friendly remainder (we printed out info where it says that K-1 holders can apply for SSN card) about my husband been able to get a SSN card.

That's what I was thinking.... thanks for the help... I think I might be able to go to an office tomorrow to try to apply for the SSN with the printed paper

Just don't mention you are married, unless they ask. Apply in maiden name. Ask to speak to the supervisor if there's a problem. Good luck.

Good news, they were able to process the application, the officer there also told that since imnmigration has my wife still registered in her maiden name, the computer would show a discrepancy if we tried using my last name. But everything went well and we have the receipt saying that we should get the card in about two weeks :yes:
