Hi after getting my congressman involved I finally got the RFE today.. My husband was born in Germany but he has a Moroccan birth certificate. They are now asking for a birth certificate to prove his country of birth is Morocco. But even on his Moroccan birth certificate it says he was born in Germany...Since I already sent that copy and the certified translation I am unsure of exactly what they want. Does anybody know what i need to send them? Should I include a note explaining? I would call the 800 number on the paper but their customer service is ran by a private contractor so all they know is what it says online...

If he was born in Germany, then he needs to get a German birth certificate. He has nothing to prove that his country of birth is Morocco because he was not born in Morocco.

The birth certificate must be original issued by the authority in the country where the person was born.

This is in the instruction about birth certificate.

BIRTH CERTIFICATE: Your birth certificate plus one original or certified copy of the birth certificate of each unmarried child under the age of 21, named in the application is required, even if they are not applying for a visa at this time.The certificate must state the date and place of birth of both parents and must be from the country where you were born.

If you cannot get a BC from Germany, you might start looking at unobtainable BC and provide best secondary evidences and include a letter to explain that.
