can u still apply for change of status even after your marriage has broken down after one yr to a us citizen as change of status had not been filed after all this time or do u have to return to the country u arrived from ?

hi, yes I know you can self-petition yourself. As long as you prove your financial capacity. I would suggest you call the USCIS so they can guide you what to do, or go to a church group or volunteer legal office that have programs on immigration.

hi, yes I know you can self-petition yourself. As long as you prove your financial capacity. I would suggest you call the USCIS so they can guide you what to do, or go to a church group or volunteer legal office that have programs on immigration.

I think part of the problem is that the original AOS was never filed even one year after the marriage, so I think this person is "out of status" which even complicates the situation more...

They've been married one year on a K-1 and never even filed the first AOS paperwork.

Correct me if I'm wrong, boo.

yes thats wot has happened ive fallen out of status so im just classed as a non immigrant with no rights ive got two kids under the age of two with my wife and and my own son whos five who lives with me here from london i dont even no were to start ive been here nearly too yrs in total an been unable too work have no money or car an cant get about to find help im taking care of our children full time wail my wife works we never had the money to file for the change of status long story. but now i have the money she telling me its not going to work out im at a loss wot to do theres so much at stake here with the kids and stuff i need some good advice cant even afford a lawyer to help me looks like im out on my ear an winters coming and have no were to go if this come to a end witch i think it most properly is.

Do you have anyone back in the UK who can help you re-establish yourself back home?

not really but of coures i have my family there but ive moved on from that life plus there oaps and wouldnt b able to help they dont have much them selfs. its about much more than just having to get on a plane an calling it a day even tho i no there might not b much choice but to have to do that at the end of the day. u no wots getting me if she nos the score and the out come of wot will happen to me and my son let alone my two girls she new along how the k1 works but im the one taking care of the kids wail shes out there earning 50k+ an alls i have to show for this is a gold band on my finger and two beautiful daughers im going to lose and its going to distroy my five yr old son i cant help to say this but shes playing god in my eyes there hasnt been a month gone buy that i havent asked her to file for the change of status an this is wot shes doing now i have the money. yet shes bought a 300 grand house and spent 60 grand on credit cards. yer thats why shes telling me we never had the money. she nos i need to go out to work my self but that never happened i live in the middle of no were nearest store if about five miles away an we live out in the woods so there really aint many places i can go just to the end of the drive to fetch the mail ive been asking her everyday for the past month wots happening with this married and that i need to no because winters around the corner and need to make plans for me and my son and she keeps telling me she dont no i cant do this much longer for my sons sake i need to find out b4 i end up in the middle of woods with no were to go in the middle of winter.

If the US petitioner refuses to assist the alien in filing for adjustment of status, it can be valid grounds for a self-petition under the provisions of VAWA.

im trying my best this is a very stressful time for me right now and if u going to just attack me each time about wot wen and how im explaning it pls dont reply i understand wot ur saying but maybe u need to look up the history of the eastend of london this is a lot bigger than that thank you.
