L1 visa vs. K1 visa

Hi all,

We are having some complications here...

We filed the K1 in June and got our NOA1 on June 22.

Meanwhile, my boyfriend was offered a position this week with the US office of his company in the Atlanta area. They said they would sponsor him for the L1 visa and want him here in two months. Not sure if that is exactly feasible but that's what they said.

We are not sure what to do because we really hoped to move out West or the Southwest. Also I have been unemployed since December and am kind of close to getting a job in other cities - not Atlanta though. It would be great for him to have a job but we just don't see ourselves in Atlanta but it could be a good opportunity for him and income.

How long has it taken your fiance/e to obtain work when all was said and done. I heard the adjustment of status takes about 5 months? The market is tough though and I worry it will be harder for him to find work as a new foreigner in the states. (although he works in software). Did your partner struggle to find work? What did they do while they waited for all the paperwork to clear?

We could just do the L1 visa instead and live in different cities but then that is not ideal and it just drags on the whole visa process.

Really hard decision to make.

Do the L1, move to Atlanta for a while.

Not sure what was there to think about.

Um the problem is I have been unemployed since December and can't find work in Atlanta. Its been a struggle, I don't want to continue my unemployment and move to Atlanta while I have other opportunities in other places.

He HAS a job in Atlanta. You MIGHT have other opportunities in another place.

2012/09/11 - Called NVC to check status, told fiance's DOB is wrong, but it's right on both application forms. They said send birth cert & passport.
2012/09/13 - Submitted DS-156 online & printed copies (& emailed to both of us).
2012/09/14 - Emailed scanned copies of original application, birth cert & passport to NVC.
2012/09/14 - Called & insisted they fix THEIR mistake. Message forwarded to supervisor. Got an email within 30 minutes; fixed! Called & confirmed.
2012/09/19 - Still in AP (Administrative/Additional Processing)... waiting...
2012/09/25 - Left NVC
2013/01/08/18 -
Third trip to Haiti
2013/01/17 - K1 Visa Denied (he had been given a fake death certificate for his first wife who was killed in the 2010 earthquake)

I continue to see no problem and nothing but benefit.

You're expecting your Fiance to move all the way from SA to USA but apprehensive about you moving a few feet, comparably?

I agree with Gowon. You say you might have a few opportunities other places that aren't Atlanta. But the case is he has a definite job in Atlanta I say move to Atlanta. Plus he'll be here faster. Maybe you will find something in Atlanta or close to it.
